Canadian Student Spousal Work Permits: Checking a 16-Month Master’s and Supporting Evidence
A spouse or common-law partner does not automatically receive Canadian work authorization because the other partner studies there. Current student-spouse eligibility depends on the student's valid study permit and qualifying course or program, together with the relationship and other application conditions. For the master's branch, the program must generally be at least 16 months long.
Read the formal credential and duration
IRCC's current instructions cover students in master's degree programs of 16 months or longer, doctoral degree programs, specified eligible programs, and listed professional university degrees. Check the actual branch before applying. A postgraduate certificate or diploma is not a master's degree simply because the school requires a previous university qualification for entry.
Obtain institutional evidence of the formal degree and program length. Do not replace the published duration with a personal plan to spread a shorter program over additional months. If there is an accelerated or unusual structure, ask the school to document it accurately and obtain an assessment of the actual rule. A tuition quotation alone may not establish the qualification or duration.
Do not extend a listed exception to similar courses
IRCC identifies specific professional degrees and eligible programs. A course with a similar subject name is not automatically included. For example, studying a general health-related certificate should not be equated with one of the formally listed professional degrees. Verify the exact credential and institution rather than selecting the closest marketing description.
The student must also have a valid study permit. An acceptance letter, a pending permit application and an issued permit are different stages. Identify the actual stage and the evidence requested for the spouse's application. A school can confirm admission or enrolment, but cannot promise the immigration outcome for another family member.
Prepare relationship evidence independently
A qualifying course does not establish a qualifying relationship. Follow IRCC's instructions for the spouse or common-law partner and provide genuine records supporting the relationship claimed. Where documents use different names, transliterations or a previous passport, explain the connection using appropriate evidence. Do not edit original records to make them appear uniform.
Separate the relationship history from the student's academic history. A clear file identifies who issued each document and what it proves. Follow the applicable translation and certification requirements for records not in English or French. A short private summary can help organize the material, but does not replace the original relationship evidence requested by the authority.
Distinguish an initial application from an extension
Someone who already holds a work permit needs the current extension instructions, not merely the initial eligibility page. Review both partners' actual permits, expiry dates and study circumstances. A permit issued under an earlier arrangement does not establish that every future extension is available on the same basis.
A final semester, graduation and transition to a PGWP can change the relevant circumstances. The worker-spouse rules applicable after graduation require a separate review. Do not assume that a student's spouse can renew indefinitely while the graduate considers employment, or that submitting one partner's application automatically extends every family member's authorization.
Budget for the authorization and job-search sequence
An open work permit can still contain conditions and an expiry date. Review the issued document before starting work, including any restriction relevant to the proposed occupation. Approval also does not guarantee employment, a wage or a particular starting date. Keep government charges, professional fees and other household costs separate when comparing quotations.
Before committing to tuition and relocation, prepare the official program evidence, both partners' immigration records and a realistic household budget. Identify how expenses will be covered if the spouse cannot work immediately. If this student-spouse route is unavailable, assess genuine alternative permits or residence arrangements on their own requirements rather than changing the course description to fit the desired answer.
