Canadian Spousal Sponsorship: Does Divorce or Job Loss End the Three-Year Undertaking?
For spousal or partner sponsorship outside Quebec, the federal undertaking generally lasts three years from the date the sponsored person becomes a permanent resident. Divorce, job loss, a move abroad or the sponsored person's later citizenship does not shorten it. Understand the commitment before signing, rather than treating the undertaking as a routine attachment to the application.
Record the correct starting event
The undertaking period does not begin on the wedding date, the day the forms are signed or the day IRCC receives the application. Keep the record establishing when the sponsored person became a permanent resident. Time spent waiting for the application decision should not be subtracted from the subsequent support period.
Do not apply the spousal period to every family member. Children can have different periods under the federal table, and Quebec has its own undertaking arrangements. Identify the intended province and the person being sponsored before relying on a duration quoted in a general article.
Understand what support involves
IRCC describes support for basic everyday needs and health needs not covered by public services, including dental and eye care. If the sponsored person receives applicable social assistance during the undertaking, the sponsor must repay it and cannot sponsor someone else until the amount is repaid. Review the actual programme and notice rather than assuming every government payment has the same classification.
For household planning, estimate real housing, food, transport and health-related costs in the intended location. This working budget is not a government tariff. A partner's expectation of quickly finding work may be reasonable as a personal goal, but should not be used as proof that no support could be needed.
Relationship changes do not erase the commitment
A separation agreement or private promise to be financially independent should not be treated as automatic cancellation of the immigration undertaking. Immigration obligations and family-law obligations may need separate advice. Provide the actual agreements and immigration dates so each professional can assess the issue within their field.
Keep a genuine record of important changes and use the appropriate notification process while an application remains pending. Do not use claims that a sponsor can simply cancel an established PR status as a way to pressure a partner. Questions about a relationship ending require accurate documents and suitable individual advice.
Financial difficulty needs practical attention
Losing a job or moving to another country does not by itself end the undertaking. If finances deteriorate, review the available resources and obtain advice about the actual obligations and any official correspondence. Ignoring a repayment notice because the couple no longer lives together can leave an unresolved problem.
Preserve the full notice, its calculation, relevant dates and the benefit programme involved. Confirm the sender and the official payment arrangements before disclosing information or sending money. Do not try to solve the issue by hiding assets or asking the other person to alter a truthful benefits history.
Withdrawal before PR is a separate stage
IRCC allows a request to withdraw sponsorship before the sponsored person becomes a permanent resident. Sending the request does not establish that it was processed in time. The official instructions expressly address requests processed after permanent residence has already begun: these do not cancel the undertaking period.
If the relationship changes during processing, obtain advice promptly and record both the facts and the notification sent. Keep the government's response. A representative saying that a request has been prepared is not the same as evidence that IRCC received and acted on it.
Read the agreement together before signing
The sponsored person also agrees to make reasonable efforts to support themselves and accompanying family members. Both people should understand that this does not make the sponsor's undertaking disappear upon the first pay cheque. Discuss the practical responsibilities and keep a complete signed copy, rather than retaining only the signature page.
For an initial review, identify the province, relationship category, PR date and the specific issue. State whether you are preparing an application, considering withdrawal or responding to an existing obligation. These are different situations; a generic three-year answer cannot decide every family-law, benefit or repayment question.
