Sponsored Spouse Open Work Permit: AOR, Living Together and the Two-Week Exception
Submitting a Canadian spousal permanent residence application does not itself authorise employment. The current sponsored-partner open work permit instructions generally require the principal applicant to be living in Canada with the sponsor and to have the permanent residence acknowledgement of receipt, or AOR. A limited route without AOR exists where the specified application and imminent-expiry conditions are met.
Identify the document you received
A submission confirmation says that something was sent. The AOR confirms that the permanent residence application has been checked for completeness and is being processed. IRCC identifies the relevant AOR as the one the sponsor receives for the permanent residence application; its application number begins with F.
Keep the original message and attachment together. Do not label an automated payment receipt, representative's upload confirmation or courier record as AOR. When asking for help, state which document you actually have and its date, rather than saying only that the PR application is already in the system.
Check the applicant's current circumstances
The official instructions require a genuine relationship and residence in Canada with the sponsor. Record where both people live now, the class under which the PR application was submitted and whether the application remains active. An overseas sponsorship application is not automatically excluded, but the work permit conditions concerning residence in Canada still need to be met.
Current temporary status is a separate question. Gather the permit or visitor record and any relevant extension or restoration records. IRCC's instructions distinguish valid permission, maintained status, qualifying restoration circumstances and applicants without valid status. These branches should not be reduced to a single promise that anyone with a pending PR application can apply immediately.
Use the no-AOR exception only where it fits
IRCC allows an application without AOR where the work permit, study permit or temporary resident status will expire in two weeks or less and the person has applied for permanent residence under one of the listed partner classes. The instructions identify the Spouse or Common-Law Partner in Canada class and the Family Class for spouses, common-law or conjugal partners.
This is an application pathway, not a general extension of stay or permission to begin a new job. Keep the genuine expiry evidence and PR submission evidence required by the instructions. Do not deliberately create an expiry emergency or describe an application still being prepared as one already submitted.
Follow the correct application branch
For the usual eligible applicant with valid temporary status and AOR, IRCC directs an online application through its secure account, with separate instructions for authorised paid representatives. Use the current personalised checklist and the additional sponsored-partner instructions. A work permit application under this policy cannot be made at a port of entry.
The out-of-status branch is different: the official page describes waiting for approval in principle where the PR application is being processed under the spousal public policy, followed by the applicable paper process. Having no current status should prompt a proper review, rather than copying the online answers used by a friend with valid visitor status.
Keep employment and travel decisions separate
Before accepting a start date, establish the legal basis for work at that point. An existing worker extending permission and a visitor seeking a first work permit may be in very different positions. The article does not determine whether a particular person may continue working while a work permit application is pending.
Likewise, the ability to submit an application is not assurance of re-entry after travel. Keep proposed travel, current immigration documents and employer commitments in the same planning timeline. Do not let a payroll deadline decide what the immigration rules permit.
If the PR application is refused, withdrawn or returned, the page says the person cannot apply under this public policy. Report such changes promptly to the person reviewing the work permit. For an initial review, provide the PR class, AOR or submission evidence, current status documents, actual living arrangements and expiry dates; omit unnecessary private relationship material from an ordinary email.
