Can an O-1 Recommendation Letter Replace the Consultation? Who May Sign and When Exceptions Apply

A standard recommendation letter does not automatically satisfy the O-1 consultation requirement simply because it is renamed an advisory opinion. The writer must be an appropriate consultation source, and the document must meet the requirements for the relevant O-1 category. A qualified expert’s letter may need to be assessed for both roles; its title or the writer’s reputation alone does not settle the question.

What each document is meant to establish

Recommendation evidence commonly explains a specific achievement, contribution, role or form of recognition. A useful letter identifies how the writer knows the work and connects the account to evidence such as publications, projects, reporting or contracts. This is an evidence-preparation approach, not a fixed recommendation-letter quota for every O-1 category.

Consultation is a separate regulatory requirement. Under 8 CFR 214.2(o)(5), consultation generally concerns the nature of the proposed work and the beneficiary’s qualifications. It is obtained from an appropriate U.S. peer group, labor and/or management organization. A peer group may include people with expertise in the field. The written advisory opinion normally accompanies the petition when filed.

Who may give the opinion?

For an O-1 extraordinary-ability petition, the regulation permits consultation with an appropriate peer group, which may include a labor organization, or people with expertise in the relevant area. A favorable opinion should describe the beneficiary’s ability and achievements, the duties to be performed, and whether the position requires the services of a person of extraordinary ability. An appropriate consulting organization may instead submit a letter of no objection when it has no objection to approval.

The rule for O-1 extraordinary achievement in motion-picture or television productions is different. It requires consultation with the appropriate union representing occupational peers and a management organization in the field. Do not import the individual-expert approach from another field without checking this rule. A written opinion issued by an organization must be signed by an authorized official.

Two limited situations to examine carefully

Where the petitioner establishes that an appropriate peer group, including a labor organization, does not exist, the regulation directs USCIS to decide on the evidence of record. One unanswered inquiry does not establish that no appropriate group exists. Identify the field and the available consultation sources before relying on this provision.

A separate provision concerns certain people of extraordinary ability in the arts who seek readmission to perform similar services within two years of the previous consultation. A petitioner seeking that waiver should provide a copy of the previous consultation and advise USCIS of the request. This is not a universal waiver for every O-1 extension, occupation or old recommendation letter.

A final document comparison

Confirm the O-1 category and the actual field of work before choosing the consultation source. Compare the advisory opinion with the petition and employment contracts so that the duties, achievements and proposed services describe the same case. A writer should not present unfamiliar work as something they personally know. Where an exception is claimed, identify the rule and its supporting evidence rather than simply dropping the document from the checklist.

Consultation opinions are advisory and do not bind USCIS. A favorable opinion or letter of no objection is not an approval of the petition. 卓越移民 Premiervisa Group can help organize questions about recommendation evidence and consultation documents around the actual O-1 work arrangements.
