188C Legacy Files: Which Fund Declaration Applies, Form 1413 or 1413D?

Forms 1413 and 1413D are not interchangeable simply because both concern investment evidence. Form 1413 identifies original subclass 188 Significant Investor applications lodged before 1 July 2015. The current downloadable 1413D identifies relevant Investor and Significant Investor applications invited on or after 1 July 2021. A file between those historical boundaries needs its applicable framework and form version checked before anyone completes a declaration.

This concerns evidence for existing 188C histories and subclass 888 preparation. The BIIP has closed to new applications. An available fund form does not reopen the initial visa route.

Recover both the application and invitation records

Keep the federal invitation, original application acknowledgement, grant notice and extension records together. Add the investment establishment and holding records. The application date and invitation date are separate events; neither should be replaced with the fund subscription date, a state nomination date or the current calendar year.

Form 1413 also directs applications lodged on or after 1 July 2015 to 1413D, while the version of 1413D now available states the July 2021 invitation boundary. An earlier file therefore requires care over the applicable version. Do not copy the current form's investment settings into a historical declaration without checking their relevance.

Match the evidence to the legal basis

Current clause 888.241 distinguishes the historical investment bases in subclauses (2A) and (2B). Subclause (4) requires a completed Form 1413 for the relevant managed-fund investments where (2A) applies, and the specified investment evidence where (2B) applies. Establish that basis before asking a manager to sign documents.

A fund declaration and an account balance serve different purposes. A recent statement may help identify a holding, but it does not necessarily establish the fund information or the whole historical period required for assessment.

Who completes the declaration?

Form 1413 assigns the fund details and declaration to the relevant fund manager. The primary applicant supplies their own client details. Applicants should not sign for a manager or treat a salesperson's verbal assurance as a completed declaration.

In 1413D, Part A contains client details. Parts B, C and D concern venture capital and growth private equity, emerging companies and balancing investments respectively, for completion by the relevant fund manager. Check the fund and manager names, licence details, amount and signature date against the actual investment records.

Fund structures and changes need an explanation

The current 1413D permits a fund-of-funds structure and refers to a declaration by the manager with overarching control. It also contains fields for underlying fund information where applicable. Ask the provider which parts correspond to the actual structure, rather than assuming one consolidated statement supplies everything.

Where a fund or manager has changed its name, obtain a record connecting the names and dates. If a signed declaration is wrong, return it to the issuer for correction. Do not edit a signature, amount or historical date to make separate documents appear consistent.

Keep a clear version record

Record the download date, the form's printed design date and the dates governing the applicant's history separately. A newer design does not automatically apply to an older file. Keep the applicable declaration with the subscription, holding and change records so the reviewer can follow the evidence.

卓越移民 Premiervisa Group can help organise the document questions for an existing 188C file. Investment continuity, residence, nomination and the other 888 conditions still require separate assessment. A completed fund declaration is evidence, rather than a guarantee of permanent residence.
