Changing Employers on O-1: New Petitions, Amendments and the Start Date
Changing employers while in the United States in O-1 status requires an immigration filing. Under 8 CFR 214.2(o)(2)(iv)(C), the new employer must file a petition and a request to extend the beneficiary’s stay. Where an agent filed the original petition, an amended petition must include evidence relating to the new employer and a request for an extension of stay.
Identify the petitioner before planning the move
Start with the original petition and approval notice. Was the petitioner the direct employer or a U.S. agent? A recruiter who introduced the role, a company that handles payroll, and the person who assembled the application are not necessarily the petitioner. Check the actual filing and approval rather than relying on informal descriptions of the arrangement.
If a direct employer filed, moving to a different company brings a filing responsibility for the new employer. If an agent filed, keeping the same agent does not automatically bring every new employer or engagement within the existing approval. The regulation expressly addresses amendments where an agent-filed case involves a change of employer.
Make the new employment record consistent
Collect the new employer’s legal name and address, duties, compensation, service dates and work locations. Compare these details against the contract. Work in more than one location requires an itinerary with the relevant dates and locations. For an agent arrangement, identify the relationships among the agent, actual employer and beneficiary.
The regulation calls for copies of written contracts or, where no written contract exists, a summary of the oral agreement’s terms. That alternative does not replace the other evidence applicable to the petition. Check the qualifications, activity description and consultation requirements separately. Retain signed versions and later amendments so the service dates and terms can be reconciled.
A continuing employer can still need an amendment
Section 214.2(o)(2)(iv)(D) requires an amended petition, with the applicable fee, when there are material changes to the employment terms and conditions or the beneficiary’s eligibility specified in the approved petition. An unchanged company name does not establish that the approved circumstances remain unchanged.
Prepare a before-and-after record of the duties, activity, terms and effective date, supported by the relevant documents. Whether a particular change is material needs a factual assessment. An administrative update and a substantive change to the approved work are not necessarily the same thing; a similar job title does not settle that question.
The additional-performance exception has limits
For an artist or entertainer, the regulation permits additional performances or engagements during petition validity without an amendment on that basis, provided they require someone of O-1 caliber. The provision is limited by the type of beneficiary, the validity period and the nature of the added work.
It is not a general permission for every O-1 beneficiary to take unrelated work. Where an added engagement also involves a change of employer or another material change, those requirements need their own assessment. A business or science beneficiary should not apply an artist-or-entertainer exception simply because both use the O-1 classification.
Do not set the start date from a receipt alone
Section 274a.12(b)(13) links O-1 employment to the petitioning employer or agent and the applicable restrictions. O-1 status is not unrestricted employment authorization. An old approval, a signed offer or a new petition receipt should not by itself be treated as confirmation that work for the new employer may begin.
Before committing to resignation and onboarding dates, have the approval notice, recent admission record, current and proposed contracts, and filing timeline checked by a professional familiar with U.S. immigration rules. The actual work-start decision depends on the person’s authorization and case circumstances. Someone outside the United States also needs to check the relevant visa and admission steps rather than copying an in-country extension procedure.
The O-1 programme information from 卓越移民 Premiervisa Group can help organize questions and documents for that review. Align the employment timetable with the immigration arrangements before finalizing work and travel dates.
A professional athlete traded to another organization is subject to a specific regulatory rule; that situation needs a separate review.
