Can Family Members of a Hungary Guest Investor Work?

A family member’s Hungarian residence permit for family reunification does not, by itself, mean they can start any job. The immigration authority says an applicant who intends to work generally needs the residence and employment request handled through the single application procedure when the family permit is issued or extended. The result depends on the application route, job category and permit actually granted.

Separate the family residence basis from permission to work

Family reunification provides a residence basis. Employment must also meet the applicable work rules. The authority links work eligibility to a single application that combines residence with a proposed employment relationship. The permit may be tied to the employer and work details approved. A family-reunification card alone should not be treated as unrestricted permission to work.

Include the job when filing where required

If the family member has a specific job offer or preliminary agreement, confirm the role, employer and work location before filing or extending the family permit. The family-reunification factsheet says the application must include the relevant employment, Hungarian Card or National Card appendix, depending on the person’s employment category and nationality. Filing only for family residence and looking for a job later may require a separate procedure.

Check the permit before changing employer or duties. A work authorisation granted for one employer or role is not automatically permission to transfer to another job. Self-employment is a different route and should be checked separately; an employee application may not cover it.

The authority gives a five-day notification deadline

The family-reunification guidance says the immigration authority must be notified of an intention to enter an employment relationship immediately after the preliminary agreement is concluded, and no later than five days after it. Confirm the current notification method, documents and start date with the authority and employer. Prepare the employer details, role, preliminary agreement and residence materials before filing to avoid a sequencing problem.

Some cases follow a different route

The official single-application guidance describes exceptions. One example concerns a person who has lawfully resided in Hungary for at least one year before applying, holds a valid family-reunification permit, and whose sponsor’s employment is exempt from a work-authorisation requirement. All parts of that exception must be met; holding a family card for a year alone does not establish a right to work. Nationality, job type and sponsor status can also affect the procedure.

A practical pre-filing check

First confirm the family member’s eligibility and filing location. Then obtain accurate role and employer details, identify the relevant employment procedure and appendix, submit the required residence and work documents, and keep the filing and notification receipts. Before the person starts work, check the permit issued and the employer or conditions it specifies. This article summarises public guidance and does not determine an individual application.
