Hungary Family Reunification Refusal: Appeal Deadline and Filing Route
If a Hungary family-reunification residence application is refused, check the decision’s delivery date, reasons and appeal instructions first. The National Directorate-General for Aliens Policing (NDGAP) says an appeal may be filed within eight days of delivery. It must be submitted to the first-instance authority or the Hungarian diplomatic or consular mission where the application was lodged. The deadline is short, so check it as soon as the decision arrives.
The eight days run from delivery of the decision
The authority’s guidance says “within eight days of delivery”; it does not describe this as eight working days or a period starting when an adviser forwards the decision. Keep the envelope, electronic notice and delivery timestamp, and follow the formal date and instructions stated in the decision. If the delivery date is unclear, confirm it immediately with the receiving authority or a qualified legal professional.
Send the appeal to the competent authority
The official factsheet identifies the first-instance authority or the Hungarian diplomatic or consular mission where the application was submitted as the filing route. Sending an explanation to a general enquiry email may not complete a formal appeal. Follow the decision’s instructions on where and how to submit, and keep proof of filing.
An authorised person must state the grounds
The authority says an appeal may be dismissed without examination on the merits if it is submitted by a person who is not authorised or does not state its grounds or cause. Compare the refusal reasons with the evidence in the file, identify what is being challenged and provide documents that support the grounds. This article does not assess the merits of an individual appeal.
The factsheet also warns that an appeal may not be examined on its merits if it relies on new facts that the applicant already knew before the decision was adopted. A bundle of additional documents does not automatically solve a refusal. Check when each item became available, whether the applicant previously knew it and what the decision requires.
A practical first response
Record the delivery date and appeal deadline; identify the refusal reasons and the documents cited; confirm who is authorised to file and where it must be sent; prepare grounds that address the decision; and obtain formal proof of submission before the deadline. If the refusal has significant consequences, seek qualified legal advice promptly rather than waiting until the final day.
If you are preparing an initial application, first check the family categories and relationship evidence:
卓越移民 Premiervisa Group can help organise the application record and documents connected with a refusal. The deadline, legal grounds and case strategy should be checked against the formal decision and advice from a qualified legal professional. Checked against official guidance on 22 October 2026.
