Australia National Innovation Visa (858): Eligibility, Invitations and Evidence

Australia’s National Innovation visa (subclass 858) is an invitation-only permanent visa for people with an internationally recognised record of exceptional achievement. Working in AI, founding a company or holding patents does not, by itself, establish eligibility. The practical question is whether independently verifiable achievements support your own case, and whether the remaining visa requirements can be met. [S1–S2]

Policy checked: 2 November 2026. The cover depicts an illustrative research setting, not an applicant, a company employee or a visa grant.

Start with the achievement, then identify the evidence

A useful first review separates three things: what your organisation achieved, what you personally contributed, and how independent people or institutions recognised that contribution. A senior job title can explain responsibility; it cannot replace evidence of individual achievement.

Prepare a short chronology with dates, your role, the result and a source that can be checked. For research, distinguish your contribution to a paper from the institution’s overall reputation. For a business, separate publicity about funding from evidence of your role in developing a product or securing adoption. For creative or sporting work, describe the level and selection process of the recognition rather than relying on the award’s name.

These are practical preparation suggestions, not a substitute for the Department’s criteria. Do not describe an issued patent as a successful commercial product unless there is separate evidence of use or adoption. An evidence table should make gaps visible before the EOI is submitted.

Age and English: the qualifications behind the headlines

The visa is not restricted to one age band. Applicants who are under 18, or 55 or older, when applying must nevertheless show exceptional benefit to the Australian community. For those aged 18 or over, the rules address functional English; a second instalment of the visa application charge applies where functional English is not demonstrated. These conditions make “no age or English requirements” an unreliable description. [S2]

Before choosing an English-evidence strategy, check what documents the Department accepts for your situation. Budget separately for any applicable second instalment and discuss timing before committing to a submission date. Family members’ circumstances also need individual review; do not assume the principal applicant’s evidence answers every family question.

EOI, invitation and visa decision are separate stages

Use the dedicated National Innovation visa EOI form linked from Home Affairs, rather than a SkillSelect submission. The EOI guidance asks for a passport identity page, CV and highest-qualification evidence. Supporting material must be in English or accompanied by English translations; cloud-storage links cannot be accessed by the Department. Its published instructions allow pdf, jpg and png files. [S3]

Check the final upload set and every declaration before submitting: information cannot be added to a submitted EOI. Submission acknowledges interest in the programme, not a visa application or an entitlement to an invitation. If an expert government agency nominates you, additional agency nomination documents are required with the EOI. [S3]

An EOI remains active for two years. An invitation, if issued, gives 60 days to lodge the visa application through ImmiAccount. The completed Form 1000 belongs with that application. An invitation does not establish that the visa will be granted. [S1, S4]

Keep a private copy of the submitted information and attachments. While waiting, organise supporting records and track anything that could affect the proposed application. Receiving an invitation with an unprepared nomination or incomplete documentation can leave little time to resolve avoidable gaps.

What a nominator is being asked to confirm

Form 1000 records the nomination supporting an applicant’s achievements. Eligible nominators include an Australian citizen, permanent resident, eligible New Zealand citizen or Australian organisation, subject to the applicable requirements. The form asks about reputation in the relevant field and the basis for supporting the applicant. [S5]

A practical approach is to identify who can explain your work with appropriate knowledge and supporting material. Give that person accurate records and time to consider them independently. Do not ask a consultant to manufacture a relationship, obtain an unsupported signature or promise a favourable assessment. A nomination should be consistent with the rest of the evidence.

Invitation priorities are not automatic eligibility

The published order gives first priority to exceptional candidates with international top-of-field awards. Second priority concerns candidates nominated on Form 1000 by an expert Australian, state or territory government agency. The next two priorities address exceptional achievements in Tier One and Tier Two sectors respectively. [S4]

Tier One covers critical technologies, renewable and low-emission technologies, and health industries. Tier Two includes agri-food and AgTech, defence and space, education, financial services and FinTech, infrastructure and transport, and resources. The first two priorities can extend across sectors. Sector membership alone does not establish an invitation or a grant, and government agency nomination is different from an ordinary professional endorsement. [S4]

For an AI founder, for example, the useful preparation is a clear account of the technology, personal contribution and independently supported impact. Attaching a fashionable sector label to an ordinary CV does not answer those questions. Avoid interpreting one invitation period’s totals as a personal success rate.

Prepare a cost schedule and a decision file

Check the current subclass 858 charges and Visa Pricing Estimator before payment. Keep government charges, any applicable English-related second instalment, family charges and third-party expenses separate. Translation, examinations and professional advice should each have their own budget line. A professional service quotation is not the total government cost. [S2]

For an initial discussion with 卓越移民 Premiervisa Group, prepare a dated CV, a brief list of your strongest achievements and links or documents that support each claim. Note your age, family composition, current location, English evidence and any nomination discussions already underway. Share sensitive identity documents only through an agreed channel when needed.

The purpose of that review is to identify the evidence that supports a possible route and the questions still requiring assessment. It is not a promise of invitation, processing time or approval. If the record does not yet support the proposed case, the next step may be to strengthen the evidence or examine another appropriate route.
