491 to 191 Visa: Requirements, Tax Notices and Application Steps

8 min read

A subclass 491 visa does not automatically become permanent residence after three years. The subclass 191 Regional Provisional stream is a separate application with its own criteria and evidence. Home Affairs identifies eligible 491 and 494 visas, at least three years of holding the eligible visa, relevant ATO notices of assessment and compliance with visa conditions. The current guidance states that there is no minimum income requirement. Those points need to be checked together rather than reduced to a salary target or an arrival anniversary.

This guide focuses on planning the transition from 491 to 191. It connects the key requirements to a practical document review and the application stages. The different 191 Hong Kong stream is outside this guide. Existing permission, family circumstances and unusual visa histories need individual assessment by an appropriately authorised Australian migration professional.

The 491 to 191 requirements at a glance

Question

Official starting point

Preparation task

Eligible visa

Hold an eligible 491 or 494 visa when applying and have held it for at least three years

Review the actual grant and visa history

Tax evidence

ATO notices for three relevant income years out of the five years of the eligible visa; no minimum income requirement

Identify the applicant and income year on each notice

Compliance

Comply with the eligible visa's conditions while in Australia

Review the whole history and explain uncertainties

Personal and family checks

Other applicable requirements remain relevant

Prepare individual identity, relationship, health and character records as required

The table is a review framework, not an eligibility result. An applicant can reach the holding-period milestone while another requirement remains unresolved. Three tax documents can also be available before the family has completed its wider preparation. Keep those questions separate so the intended filing date follows the evidence.

Step 1: establish the visa chronology

Retrieve the 491 grant notice and current status information. Record the grant date, expiry, conditions and whether the person was the primary or a secondary applicant on the earlier visa. Add earlier or subsequent visas to a chronology without assuming all periods can be combined. Ask for an individual review where the holding history is unusual.

Record arrival dates separately from grant dates. Someone granted a visa offshore may arrive later; a person may also have spent years in Australia on another visa before 491. These dates help explain the history but should not replace the criterion concerning holding the eligible visa. Avoid choosing whichever anniversary produces the preferred school, work or housing timetable.

Review the chronology for each possible principal applicant in the household. The earlier application order does not answer every question about the later 191 application. A partner's history and documents belong to that person, and a family member who joined later may have a different timeline. Assess the appropriate application structure before assigning everyone's records to one file.

Step 2: map the relevant ATO notices of assessment

Home Affairs currently requires ATO notices of assessment for three income years out of the five years of the eligible visa. There is no minimum income requirement. A low income figure and a missing notice are therefore different issues. Neither an old proposed salary threshold nor a friend's earnings should be substituted for the current official requirement.

Make a row for each potentially relevant income year. Record whether the return needs review, has been lodged, is being processed or has resulted in an issued notice. Identify any amended notice. Match each document to the individual applicant and the underlying income year; the date the notice was issued is a separate piece of information.

A lodged return, submission receipt or accountant's estimate is not automatically the ATO notice required for immigration evidence. Obtain the genuine assessment record through the appropriate official or tax-agent channel. If a year has no notice, ask a tax professional about the actual filing position and the migration professional about the immigration evidence issue. Do not submit an inaccurate return simply to generate a document.

Step 3: review conditions across the whole period

Read the conditions attached to the actual visa and review where the person lived, worked and studied while in Australia. Home Affairs' compliance requirement concerns the period of holding the eligible visa, not only the weeks immediately before the 191 application. A current visa-status result does not explain every historical event or resolve an uncertain compliance issue.

Prepare an address chronology with moves, shared accommodation and overseas absences. Explain genuine gaps using the records available. A mailing address is different from a home, and an employer's head office may differ from where an employee physically worked. Remote work and travel need a factual account rather than a blanket assurance based on one postcode.

Connect relevant employment and study records to that chronology. Keep contracts, location information and explanations of changes where they help establish the facts. Do not create a fictional lease or alter work history to make the record appear uninterrupted. Flag issues for advice before selecting an application date; reaching an anniversary does not erase an earlier problem.

Step 4: assess the family's application structure

List every intended applicant with their relationship, date of birth, current visa and location. Identify events that may require attention, such as a child approaching adulthood, a marriage or separation, a family member remaining overseas or a parent not accompanying a child. Ask which current rules and documents apply to each person rather than assuming the household has one shared eligibility result.

Where the family is considering a different principal applicant, compare the actual eligible-visa history, notices and compliance evidence for each candidate. One person's ATO notice cannot simply be relabelled as another person's income record. Individual readiness matters more than who earns the most or who was named first on an earlier application.

Identity, family membership, health and character matters remain separate from tax evidence. A complete set of tax notices does not establish that every relative can be included or that every supporting document has been prepared. Use the specialist family and consent guides where relevant, and have the application structure confirmed before paying for extensive document work.

Step 5: assemble a usable document file

Organise the file into identity, visa history, tax notices, conditions and residence evidence, and family-specific records. Use filenames that identify the applicant and document purpose without exposing unnecessary sensitive numbers. Keep originals and reviewed copies together. The aim is to let a reviewer trace a claim to its supporting record without reconstructing months of messages.

For overseas documents, confirm the receiving authority's translation and certification instructions. Names, dates and relationships should be consistent, or accompanied by a truthful explanation and supporting records where appropriate. Do not order every conceivable certificate at once: first establish the applicable checklist and which records are missing or time-sensitive.

Create an issues register beside the document folders. Record the question, evidence available, person responsible and next action. A requested document is still outstanding until it is received and reviewed. This distinction makes it easier to decide whether the file is actually ready rather than merely large.

Step 6: compare costs and timing using the same scope

Check the current official visa charge for the application and actual family composition. Use the Home Affairs pricing service at the point of action rather than relying on a historical screenshot. Keep government charges separate from professional work, translations, examinations, certificates and other expenses. A quoted principal charge should not be presented as the total household budget.

Ask for a written professional scope identifying assessment, preparation, lodgement and responses to later requests. Record payment milestones, exclusions and the treatment of work that is not performed. A cheap assessment quote and a full application service are different products. Compare proposals after making those differences visible.

Separate preparation time from government processing. An adviser can estimate their own document work; they cannot guarantee the Department's decision date. Official processing information is a guide based on its stated scope and can change. Avoid making irreversible employment, travel or property commitments depend on an unissued grant or a promised completion month.

Step 7: lodge the application and manage what follows

Use the current Home Affairs instructions for the Regional Provisional stream and the actual ImmiAccount application. Review the facts and documents before authorising submission. Keep the final approved application, acknowledgement and payment record. Lodgement is a milestone; it is not permanent residence and does not establish that the Department has accepted every claimed fact.

Agree who monitors official communications and how requests will reach the applicant. Respond through the appropriate channel with a coordinated explanation and supporting records. If information is corrected, make the correction transparent and retain the source documents. Repeatedly uploading contradictory versions without explanation can make a simple question harder to review.

Home Affairs currently asks applicants with ATO debts to provide evidence of repayment or an approved payment plan to avoid processing delays. Treat that as a separate matter from low income and the notice requirement. Tax advice and immigration advice have different purposes; coordinate them using the actual records rather than assuming one professional has resolved both.

Keep current status and travel outside the future-PR calculation

Continue to understand the permission actually held while preparing and awaiting a decision. An intended application or a consultation does not extend a visa. Where a bridging visa is involved, confirm when it operates, its conditions and any separate travel requirement. Do not assume every application produces the same bridging arrangements.

Before leaving Australia, review the current visa, return permission and effect of travel on the application or evidence position. Maintain accurate dates and addresses after lodgement. Permanent residence begins with the relevant grant, not with the 491 anniversary, submission of a tax return or payment of an application charge.

A worked readiness review

Consider a hypothetical family whose 491 grant anniversary is approaching. The proposed principal has two issued ATO notices, a lodged return still being processed and a period of shared accommodation with limited bills in their own name. The useful actions are to establish the relevant income years, retrieve the actual third notice when available and explain the accommodation using genuine supporting records.

Buying another English test or combining a partner's tax record into the principal's inventory would not answer those particular questions. Nor does the example prove that waiting for one document will resolve the whole case. A professional review must consider the visa history, conditions and family criteria as well. The purpose is to direct preparation towards the actual unresolved requirement.

Frequently asked questions about 491 to 191

Is 491 already permanent residence?

No. It is a provisional regional visa. The 191 Regional Provisional application is a separate step, and a grant depends on meeting the applicable requirements. Plan the transition using the evidence, not the description of a future pathway in a sales presentation.

Does a low-income year automatically prevent 191?

The current official guidance states that there is no minimum income requirement. The relevant ATO notices and other criteria still matter. Have low income, missing assessments and any tax-filing issue examined as distinct questions.

Is this the same as the 191 Hong Kong stream?

No. The Hong Kong stream has different passport, visa and residence requirements. Identify the complete stream name before importing a checklist or English-related payment arrangement from another article. The visa number alone does not make the rules interchangeable.

Can a consultant guarantee the grant after three years?

No. A documented review can explain the current requirements, evidence gaps and preparation tasks. It cannot replace the Department's decision. Ask for a written assessment and service scope that distinguish what can be delivered from the eventual outcome.
