Unpaid Leave on a UK Skilled Worker Visa: Four-Week Totals and Sponsor Reporting
An employer approving unpaid leave does not by itself resolve the Skilled Worker sponsorship consequences. Current sponsor guidance normally requires sponsorship to stop where unpaid or reduced-pay absence exceeds four weeks in total in a calendar year, unless an applicable exception or accepted compelling reason supports continued sponsorship. Check the actual leave history before agreeing dates.
Count the total, not just the longest trip
The rule can apply to a single long absence or several periods that together exceed the threshold. For Skilled Workers the relevant calendar year runs from January to December. Keep previous unpaid and reduced-pay leave in the calculation rather than asking only whether the next trip lasts less than four weeks.
The guidance measures four weeks according to the person's normal working pattern. An employee who usually works fewer days each week should not automatically use the working-day total of a five-day employee. Obtain the actual contract and leave records so the sponsor can make the calculation on the correct basis.
Identify the reason accurately
The guidance lists permissible reasons, including specified statutory family leave and sick leave, with conditions and reporting duties. Do not assume that every personal request is equivalent to statutory leave or that a manager's sympathy establishes a formal exception. Record what the absence is for and the evidence supporting that classification.
Where the sponsor believes compelling reasons justify continued sponsorship outside a listed exception, the guidance requires reporting for UKVI to consider. A report is not a guarantee that the explanation will be accepted. The worker and sponsor should understand the unresolved position rather than treating an internal HR approval as the government outcome.
Separate absence from a permanent pay change
Unpaid leave, reduced-pay absence and a general reduction in contractual salary are not the same event. If the employer proposes fewer hours or lower basic pay as a continuing arrangement, check the applicable salary and sponsorship requirements independently. Do not describe a permanent reduction as temporary leave merely to avoid a calculation.
Obtain the genuine revised terms and proposed dates before they take effect. The sponsor may have reporting, CoS or application responsibilities depending on the change. An employee should not be told to return part of a stated salary privately so the official payroll appears to satisfy a requirement that the real arrangement does not meet.
Keep authorised and unauthorised absence distinct
The guidance separately addresses absence without the sponsor's permission. A worker who cannot attend should follow the employer's reporting procedure and keep accurate communication. Later producing a leave request does not establish that the employer approved the original absence at the time.
Maintain the actual dates, reason, approval and pay treatment. Where a health or family issue makes evidence difficult to obtain immediately, explain the facts and what records are available. Do not invent a medical document or ask payroll to move dates to conceal the real sequence.
Review travel and residence separately
Sponsorship treatment of leave is different from entry documents, pending-application travel rules and later settlement absence calculations. An employer agreeing to unpaid leave does not determine all those issues. If travel is planned, provide the actual application and permission status alongside the leave request.
Likewise, a permitted employment absence should not automatically be removed from the residence history for settlement. Different rules answer different questions. Keep the journey and leave records linked so the adviser can assess each consequence using the same truthful dates.
Agree responsibilities before leave starts
The worker should know who in the sponsoring organisation will review the records, make any required report and communicate the outcome. Keep a written record of the actual arrangement and any subsequent change. 卓越移民 Premiervisa Group can help organise the employment, permission and leave history for an appropriately qualified adviser to assess with the sponsor, while any government response remains clearly distinguished from internal approval.
