UK Skilled Worker New Entrant Salary: Graduate Time and the Four-Year Limit
The Skilled Worker new entrant option is a conditional salary arrangement, not a permanent graduate discount. Under the current standard option, both the relevant annual minimum and the required percentage of the occupation's going rate must be met. Check the applicant's qualifying basis and previous permission before an employer promises several years at the lower salary.
Identify the qualifying basis rather than using a label
The current rules provide specified bases involving age, relevant Student or Graduate history, professional training and certain postdoctoral employment. They are not a general concession for everyone who has recently entered the labour market. Record which basis is proposed and preserve the evidence needed for that particular branch.
For an age-based claim, the application date matters. For a course or permission-history claim, obtain the real qualification, course status and visa dates. A CV describing the person as a recent graduate is a starting point for gathering documents, not proof that the formal conditions have been met. Different qualifications and periods of study should be described accurately.
Apply both parts of the salary test
GOVUK currently describes the standard new entrant arrangement as at least £33,400 a year and 70 percent of the applicable standard going rate. A salary meeting the first figure can still be insufficient where the occupation-specific calculation is higher. The role, hours and actual countable pay therefore need to be reviewed together.
Transitional and other salary options require their own assessment. Do not choose the lowest figure visible anywhere on an official table without establishing that the applicant belongs to that option. Ask the employer or adviser to show the occupation code, working hours, relevant table and calculations supporting the proposed CoS.
Count Graduate and sponsored permission correctly
The formal rules limit the combined relevant Skilled Worker, Graduate and Tier 2 permission associated with this assessment to four years, whether or not continuous. Previous Graduate time is not ignored simply because the new employer did not sponsor it. A break between permissions should not be assumed to reset the calculation.
Prepare a complete permission history showing the route and dates of each grant, not just travel stamps or employment start dates. Where a period is uncertain, obtain the actual decision rather than estimating from memory. The proposed new grant must be checked against the full history before selecting its length or paying application costs.
Discuss the later salary now
An employer may be able to support an initial application but need to increase pay before a later application can meet the relevant requirements. Record when a fresh review will be needed and who is responsible for obtaining the occupation and pay information. An anticipated future promotion should not be stated as an approved immigration solution.
Any private agreement about pay progression needs to reflect genuine employment terms. A side letter promising to return part of the stated salary can undermine the calculation rather than make it stronger. Use the actual guaranteed remuneration and disclose relevant deductions or arrangements for proper review.
Do not combine unrelated exceptions
A PhD salary option, a listed healthcare role and a new entrant claim each have distinct criteria. Holding a doctorate does not make the most favourable percentage available in every job. Likewise, satisfying a Student-related salary option does not by itself establish permission to switch or to begin working in the proposed role immediately.
Keep sponsorship, switching eligibility, English evidence and the salary option as separate checks in the same file. This makes it easier to identify the real missing evidence without collecting documents that do not answer the question. The eventual decision still depends on the complete application and current rules.
Prepare for the next application before the current one ends
Retain the approved permission, CoS, employment contract and calculation used. Review changes to duties, hours and pay when they occur. Before extension, allow enough time to assess the salary option then available rather than assuming the original new entrant basis continues indefinitely. 卓越移民 Premiervisa Group can help assemble that history for an appropriately qualified adviser to assess with the employer.
