UK Skilled Worker Eligibility in 2026: Job, Salary, English and Family Checks

UK Skilled Worker eligibility depends on an actual eligible sponsored job and the applicant's own circumstances. An employer's willingness to help, an English-language CV or a salary above one headline figure does not establish the complete application. Review the role, sponsor, remuneration, English evidence and immigration history together before committing to a move.

Establish the job and the sponsor

Obtain the employing legal entity, proposed duties, occupation code, hours and location. Confirm that the sponsor and role meet the relevant requirements. A recruitment agency's general promise of sponsorship is not a CoS for the actual job, and a familiar group brand does not identify which legal entity will employ the applicant.

Use the real duties to assess the occupation. Do not select a code solely because it appears on an eligible list or has a lower salary requirement. The contract, CoS and application should describe a consistent genuine arrangement. If the role changes, revisit the assessment before relying on earlier advice.

Calculate salary using the applicable option

The general standard currently involves £41,700 and the occupation's going rate, with specified other options and transitional provisions. Meeting one annual figure is not enough where the applicable going rate is higher. Working hours, countable pay and the actual option need to be documented rather than inferred from the advertised total package.

A relevant PhD, a new entrant basis or a listed healthcare or education role can raise different provisions, each with its own conditions. Do not combine the lowest annual threshold from one option with the percentage from another. Ask the employer or adviser to identify the rule and show the calculation supporting the proposed salary.

Use the current English requirement

GOVUK currently sets B2 for the relevant new Skilled Worker applications and switching from a different route. It also describes specific existing-holder extension or update arrangements involving permission held before 8 January 2026. A previous application must be reviewed using its actual route and history, not merely the fact that the applicant has lived in the UK.

Evidence can involve an accepted qualification, an approved language test or an applicable exemption. An employer interviewing someone in English does not automatically satisfy the immigration evidence requirement. For a degree taught in English outside the UK, check the relevant Ecctis process rather than assuming an institutional letter always settles the question.

Plan the route and submission location

An overseas application, an in-country switch and a sponsored employer change are different procedures. Current permission may restrict whether switching is available or when a Student can qualify. Obtain the actual documents and course dates where relevant, and do not begin a new role solely because an application has been prepared.

Record the genuine submission and identity stages. A saved form, booking or adviser payment is not the same as a valid application or approval. If travel is planned while an in-country application is pending, review the specific withdrawal rules before booking. An unexpired passport does not resolve that separate issue.

Assess family and budget separately

A partner and children need their own eligibility and applications. Occupation-related restrictions and transitional circumstances can affect the family even where the principal worker qualifies. Keep each person's location, relationship, permission and expiry clear instead of describing sponsorship as one automatic household approval.

Budget for current government charges, any applicable healthcare surcharge, document expenses and professional fees separately. Do not treat a minimum maintenance amount or an employer's contribution as the complete relocation cost. Housing, schools and personal travel have separate prices and cancellation conditions.

Treat settlement as a later assessment

A Skilled Worker grant is temporary permission with conditions. It does not itself approve settlement or guarantee that future requirements will remain unchanged. Keep the employment, pay, permission and travel records needed for later review, and distinguish a consultation or proposed policy from a rule already in force.

卓越移民 Premiervisa Group can help organise the role, qualification, immigration and family evidence for an appropriately qualified adviser to assess. Identify unresolved points before submitting, use genuine documents and retain the actual government decisions rather than treating a private eligibility estimate as the final outcome.
