UK Skilled Worker Criminal Record Certificates: Occupation Codes, Residence History and Partners
Not every Skilled Worker application has the same criminal record certificate requirement. Start with the actual occupation code and whether the application is for entry clearance. Specified roles in fields such as health, education and social services have additional certificate requirements, and an accompanying partner may need their own evidence.
Check the code rather than the workplace description
A person working for a hospital or school should not rely solely on the employer's sector to decide which documents are required. Match the sponsored job to the current formal list of occupation codes. A non-clinical role in a healthcare business and a listed clinical profession may raise different questions.
Retain the job description and CoS so the adviser can identify the relevant requirement. If the code changes during recruitment, revisit the evidence list. Do not let an earlier checklist remain the final instruction after the underlying sponsored role has changed. A broad internet description of healthcare jobs is useful for initial screening but is not a substitute for the formal list.
Build a country history with the correct test
For the relevant entry-clearance requirement, the formal rules refer to countries where the applicant was present for 12 months or more, continuously or in total, during the ten years before application while aged 18 or older. This is not simply a test of the passport country or the longest single uninterrupted stay.
Prepare an accurate chronology of residence, study and work abroad, supported by genuine records where needed. Include separate visits when their total may be relevant. Do not use an address currently shown on a bank statement as the entire travel history, and do not omit a previous country because obtaining its certificate may take time.
Review the partner independently
The formal rules also address entry clearance for a partner of a Skilled Worker sponsored in the specified occupations. The partner's own history must be considered; the principal applicant's certificate does not cover another adult. Keep the family applications connected while identifying each person's documents separately.
A partner not working in the same profession should not assume that this automatically removes the dependant-related requirement. Ask the adviser to identify the basis applicable to the actual application. Children and other family circumstances should likewise be checked against their own rules rather than copying an adult checklist without review.
Follow each issuing authority's real procedure
Certificates from different countries can have different issuing bodies, application requirements and delivery arrangements. Use the relevant official guidance for the document being requested. Keep the original, any required translation and evidence connecting a previous name or passport to the applicant.
Do not assume that a private background-screening report, employer reference or self-written declaration is equivalent to the government certificate required. Where an authority needs an official request or other supporting document, obtain it through the proper process. Avoid creating a document that appears to have come from a government agency or altering travel dates to avoid a requirement.
Explain genuine obstacles with evidence
The formal rules provide for a satisfactory explanation where obtaining a required certificate is not reasonably practicable. This needs the actual facts and supporting evidence; it is not a universal exemption for a late request or an inconvenient process. Preserve applications, official responses and a clear chronology of attempts to obtain the document.
An explanation letter should say what happened and what can be verified. It should not assert that a certificate was issued when only a request exists. Let the adviser assess the applicable approach using the complete record rather than promising that a substitute document will necessarily be accepted.
Keep immigration and employer screening separate
An employer or professional regulator may have its own safeguarding or background checks. Completing one process does not automatically satisfy the other. Keep the purpose of each certificate clear and confirm any current timing or document requirements before applying. 卓越移民 Premiervisa Group can help organise the occupation and country-history records for an appropriately qualified adviser to identify the remaining evidence and the relevant official procedures.
