UK Skilled Worker Side Work: The 20-Hour Rule, Own Business and a Second Sponsor

A UK Skilled Worker visa does not allow unrestricted side work. GOVUK permits up to 20 hours a week in another job or your own business only where the relevant conditions are met and you continue doing the sponsored job. Before accepting clients or shifts, identify the work category and the time you will actually spend on it.

Classify the additional work

The current instructions identify eligible higher-skilled work, work on the Immigration Salary List, or work in the same sector and at the same level as the main job. Medium-skilled additional work has specific historic CoS and continuous-permission conditions. Do not assume that any vacancy becomes eligible merely because it is offered outside your normal working hours.

Keep the proposed duties, occupation information and working arrangement available for review. A marketing title such as consultant, contractor or founder is not enough to classify the activity. Establish what you will personally do and how that relates to the relevant category before signing an ongoing commitment.

Preserve the sponsored main job

The additional-work arrangement depends on continuing the sponsored employment. It should not be used to replace the main job without considering the immigration consequences. If that role ends, hours change significantly or a new employer becomes the main employer, review the actual permission and reporting questions before assuming the side business can become the replacement.

The main employment contract may also restrict outside activities or require consent. Those contractual obligations are separate from the immigration rules. Meeting a visa condition does not remove confidentiality, conflict-of-interest or other genuine employment responsibilities. Obtain the appropriate advice where a contract and the proposed business arrangement need review.

Count more than client-facing work

For your own business, record the actual work, including relevant administration rather than counting only paid appointments. Invoicing, marketing and other business tasks take time even if no customer is billed for them. Keep a realistic weekly schedule alongside the main job instead of calculating hours solely from the number of invoices issued.

Payment into an overseas account does not itself change the activity performed in the UK. Nor does receiving money through a company mean the owner has done no work. Describe the real services, location and hours. Tax registration and company incorporation have separate purposes and should not be treated as evidence of immigration authorization.

Distinguish overtime from a second job

GOVUK treats overtime in the sponsored job differently from work in another job or one's own business. The permission for overtime should not be extended to shifts for a separate employer simply because the work is similar. Confirm the employing entity and the role for each arrangement.

If the second job exceeds 20 hours a week, GOVUK directs applicants to update their permission so they are sponsored for both jobs, with the required additional CoS and eligible employment. Approval is not automatic. An application in preparation does not authorize the expanded arrangement in advance.

Keep evidence that explains the arrangement

Retain the main contract, proposed additional duties, weekly hours and any relevant employer consent. For self-employment, keep genuine time records that include administration and explain changes in commitments. A clear record helps an adviser assess the facts; it should not be manufactured retrospectively to make excessive hours look compliant.

If work has already begun and the position is uncertain, describe what happened accurately. Do not ask a customer to rename paid work as volunteering or move an invoice date to conceal when services were performed. An unpaid label alone does not resolve whether an activity is permitted.

Review the position again when the main job, side duties or immigration permission changes. 卓越移民 Premiervisa Group can help organise the work history and proposed arrangements for an appropriately qualified adviser to assess. Employer approval, tax compliance and immigration permission each require their own confirmation before the arrangement is treated as ready to proceed.
