Your 485 Is Expiring While Your EOI Is Waiting: Checking Lawful Stay Separately

An active skilled-migration EOI does not establish permission to remain or work in Australia after your 485 expires. An EOI expresses interest; it is not a visa application or a visa. Start with your actual current permission and its conditions, then check whether there is a genuine next option. A predicted invitation date is not a substitute for lawful status.

Read the permission you have today

Use the current grant notice and VEVO record to check your visa, relevant dates and conditions. If you also have a bridging visa notice, establish whether it is already in effect and what it permits. A notice on file is not the same as that visa currently controlling your stay. Calling yourself a permanent-residence applicant does not establish work rights.

Record each family member separately, including their actual location. Do not assume every partner and child has the same expiry date. If a passport has changed, check that the current record can be linked correctly. An employer who needs evidence of work permission needs the actual visa conditions, rather than an EOI screenshot or a proposed migration plan.

Identify what each receipt proves

SkillSelect, a state nomination system and a federal visa application perform different functions. Migration Tasmania explicitly separates nomination assessment from visa assessment and states that an EOI is neither a visa nor a nomination application. Other states have their own procedures. A receipt in one system cannot simply be treated as confirmation of a lodged application in another.

When correspondence arrives, record who issued it, what it permits or requests, and the deadline. An invitation to apply for state nomination may be an earlier stage than a federal invitation to apply for a visa. A progress note saying only invited can leave the person managing your expiry date with the wrong understanding of your position.

Even after a visa application is submitted, check the actual bridging position against your personal history, valid application and grant conditions. Do not infer that a particular bridging visa is in effect merely because an online submission was made. Its work and travel conditions also need their own review rather than being assumed identical to the 485.

Keep a status timeline alongside the migration timeline

  • For current status, list each person's visa, expiry, location and actual work and travel conditions.

  • For any bridging grant, keep the complete notice and identify its commencement and conditions.

  • For migration progress, list the EOI, state process, federal invitation and any lodged application separately.

  • Put a source document beside each confirmed date, and leave uncertain invitation dates unconfirmed.

  • Assign responsibility for checking correspondence and the earliest real deadline.

This is a planning record, not an additional government application. It should reveal where your present permission may end before the next migration stage is available. You can set early internal follow-up dates, but a rumoured invitation round must not displace an expiry shown in a grant notice.

If an invitation may not arrive in time, check genuine options early, including the purpose, eligibility and location requirements of any other visa. Visitor, student or other work visas are not universal waiting arrangements. Disclose relevant refusal or cancellation history and any conditions that could limit an application in Australia. The answer depends on the real record, not a friend's successful application.

Resolve travel and practical commitments before they become urgent

Travel rights require a separate check. The Home Affairs BVA page warns that someone who needs to leave and return while their substantive application is being processed needs a BVB granted before departure. Check your own eligibility, visa position and permitted travel period. Applying for a BVB is not the same as receiving permission to return.

For a focused assessment, assemble current notices for each person, locations, expiry dates, EOI and state receipts, and official correspondence. Add practical constraints such as work handover, school terms and planned travel. If you discover that you no longer hold a valid visa, obtain prompt advice on your status rather than continuing to wait because the EOI remains active.
