Including a partner in SMC: marriage dates and 12 months of living together
A marriage certificate alone does not establish eligibility for a partner included in an SMC residence application. Current R2.1 requires a genuine and stable partnership in which the couple have lived together for at least 12 months at assessment. Qualifying cohabitation before marriage may be considered, while years since registration cannot simply replace years of living together.
Relationship form and the shared life are distinct
Recognised forms include legal marriage, civil union and de facto partnership, subject to the minimum requirements. Registration does not itself demonstrate the everyday relationship or remove each person's health, character and applicable English conditions. Identify what each document actually proves.
This concerns a partner included in the principal applicant's SMC case. It differs from a separate Partnership Category application supported by a New Zealand citizen or resident. Some relationship evidence overlaps, but the timing, support rules and procedure must be checked for the actual category rather than copied wholesale.
Build a record of the addresses actually shared
Start with dates of moving in, moving home and temporarily living apart. Genuine tenancy records, property documents and correspondence at the shared address may help. Household spending, caring responsibilities and joint decisions can explain how the couple established a life together. Not every family needs the same form of joint account.
Question | Possible evidence direction |
Where did you live together? | Actual tenancy, housing records and formal correspondence |
How did the shared life operate? | Genuine household expenses, responsibilities and arrangements |
How has the relationship continued? | Communications, photographs and public recognition |
Why were you apart? | Dates, reasons and how the relationship was maintained |
The official examples are not a fixed package where every item is compulsory or collecting them guarantees approval. The presence or absence of a single document is not determinative. Do not open an unused account or fabricate old correspondence to imitate someone else's case. Errors should be corrected through the original issuer, rather than by editing a scan.
Explain periods of separation
Work, education or family commitments may account for living apart. Such a period does not automatically disprove a genuine partnership. The assessment considers the reasons, relationship history, length of separation and efforts to be together. However, not every month at separate addresses can automatically be treated as cohabitation.
Messages and calls may show continuing contact without proving shared accommodation. Visits and holidays also differ from establishing a common home. A concise dated index helps explain the main facts; preserve the underlying records and provide relevant material as required instead of relying on a large unstructured screenshot collection.
A shorter period has a conditional procedure
R2.1 provides for a possible deferred partner decision where the relationship is genuine and stable but shorter than 12 months, subject to the principal applicant not relying on that relationship or the partner's attributes for eligibility. Where the principal does rely on them, different consequences apply. A discretionary provision should not be advertised as a guaranteed acceptance in every case.
Any related work visa option requires an actual application and the relevant conditions. Deferring a residence decision does not automatically grant work permission. Manage current visa expiry, future cohabitation and residence progress separately so an expected future qualification is not mistaken for present lawful status.
Keep earlier declarations consistent with the facts
Check relationship and address information previously given in visa applications. A correspondence address may differ from the home address for a genuine reason, but the history needs an accurate explanation. Do not rewrite earlier events merely to make every form look identical. Disclose material relationship changes as required.
For an initial review, organise the relationship form, periods together, reasons for separation, current visas and available evidence types. Sensitive messages and bank records should be shared only through an appropriate confirmed channel. The final relationship assessment depends on the full facts and current instructions, rather than the number of married years or a private service payment.
