After SMC approval: changing jobs, Section 49 and resident travel conditions

An SMC Resident Visa generally permits indefinite living, work and study in New Zealand, but any Section 49 conditions recorded on the individual eVisa still apply. Two-year travel conditions are also not an automatic upgrade to permanent residence. Before changing jobs or planning a long overseas stay, read the actual conditions and dates rather than relying on the word resident.

Identify the document and status actually granted

INZ says visa conditions can be found in the eVisa, passport label, approval letter or official verification service. Keep the complete document and check identity, category, grant date, travel expiry and additional requirements. Informal use of PR can obscure the difference between a Resident Visa and a Permanent Resident Visa.

The SMC page describes general permission to work for any employer, while also requiring compliance with individual conditions. Those statements must be read together. Another person's unrestricted arrangement does not establish what the conditions on your own eVisa permit.

Section 49 requires the individual employment history

Additional conditions may apply to some visas; they are not identical for every SMC holder. For those with the relevant Section 49 conditions, the SMC page warns against unemployment exceeding three months and requires another skilled job lasting at least three months if a job is lost. Do not treat this as an endlessly renewable three-month break after every resignation.

Retain old and new contracts, actual employment dates and relevant remuneration evidence when a role or employer changes. These facts support an assessment of compliance. Residence approval does not make the earlier work records irrelevant, and a private verbal assurance is not government confirmation.

Meeting a condition and removing it are separate steps

The SMC page sets out a request by the principal applicant to remove Section 49 conditions, supported by specified material such as a covering request, valid family passport copies and an employer letter confirming the required full-time employment. The evidence must address the individual's actual required period.

Where Section 49 applies, INZ says to meet the conditions and apply for removal before seeking a Permanent Resident Visa. Sending the request is not itself confirmation that removal has occurred. Retain the formal result and relevant updated records rather than marking the condition removed because time has passed.

Calculate travel dates from the correct event

For offshore SMC grants, the current page requires arrival within 12 months of issue. Travel conditions normally last two years from first arrival as a resident, or from grant if the person is already in New Zealand. Use the dates on the individual eVisa, rather than counting from application lodgement or a private service contract.

Family members may first arrive on different dates. Check each person's record before assuming one deadline covers everyone. Put intended departure and return dates beside the actual expiry, particularly for extended family visits or overseas work. Recheck when an itinerary changes.

Expiry overseas has different consequences

INZ warns that a Resident Visa expires if travel conditions expire while the holder is outside New Zealand. Indefinite stay inside the country is not indefinite permission to return from abroad. If travel may cross that date, investigate an eligible travel extension or permanent residence arrangement before departure.

A pending Permanent Resident Visa application is not an approval. Current travel permission still needs to cover the journey. An application to vary travel conditions takes effect only after approval and an updated eVisa; a receipt, expected processing time or flight booking cannot extend it.

Two years is one requirement, rather than an automatic conversion

Permanent residence requires the relevant continuous residence-visa period, compliance with original conditions, a qualifying demonstration of commitment to New Zealand and the other requirements. It remains an application. Citizenship and a New Zealand passport are separate matters with their own rules.

For a review, organise the condition wording, grant date, first resident arrival, present location, employment changes and proposed travel. Share necessary identity material through a confirmed channel. These actual documents provide a sound basis for planning; an informal status label or promised two-year package does not.
