Including an adult child in SMC: employment, university and financial dependence

SMC may include eligible dependent children aged 24 or younger, but age alone does not establish eligibility. A child aged 21 to 24 must be single, have no children of their own and be totally or substantially financially reliant on the principal applicant and/or partner. University enrolment, paid work, independent funds and living arrangements need to be considered together.

Use the correct age branch

Under current R2.1, single children aged 17 or younger are presumed dependent. Those aged 18 to 20 are presumed dependent if single and without children of their own. The 21-to 24 branch adds the financial dependence assessment. Do not impose every older-child financial issue on every newly adult child, or extend the younger definition indefinitely.

If a family obtained an assessment several years ago, update the child's study, employment, relationship and family circumstances. Near an age boundary, confirm the actual procedural dates and applicable instructions. Submitting an EOI should not be advertised as permanently protecting every child's eligibility regardless of later facts.

Paid work needs its context

Officers consider whether employment is full-time or part-time, its duration, other independent means, housing support and study. Occasional work is not the same as complete financial independence, while student status alone does not establish dependence. Explain who actually pays the child's costs and what resources the child controls.

R2.1 has specific provisions disregarding certain part-time work carried out under named temporary visa conditions. Evidence that the work complied with those conditions may be required. This is not a blanket exemption for every part-time job in every country. Preserve the relevant visa conditions, employment dates and accurate income information.

Connect family support to genuine expenses

Organise the real arrangements for tuition, accommodation and ordinary living costs. Where parents pay an institution directly, keep the payment and its purpose. Where support is transferred periodically, show the actual arrangement. This is an evidence-management suggestion, rather than a government requirement to create new monthly transfers before applying.

Fact to explain

Records that may help

Continuing education

Enrolment, course details and actual tuition funding

Parent-funded housing

Living arrangement and genuine associated payments

Employment or independent resources

Nature and duration of income, assets and other funding

Living away from parents

Actual address and the people meeting major expenses

Disclose scholarships, personal savings and other support accurately. A last-minute transfer does not rewrite an otherwise independent financial history. Do not say that parents pay every expense merely to simplify the narrative when original records show something different. The assessment concerns the whole situation, rather than the most favourable bank screenshot.

Different addresses do not settle the question

An adult child studying abroad may live separately from their parents. The definition expressly concerns financial reliance whether or not they live together. Conversely, sharing a home is not sufficient to establish every dependency condition. Keep residence, financial support and relationship evidence distinct.

Birth or legally recognised adoption documents establish the family connection; they do not themselves demonstrate adult financial reliance. Adoption has separate legal requirements and must be supported appropriately. An informal family explanation cannot replace necessary legal recognition.

Plan temporary status separately from residence inclusion

Temporary visitor and student categories do not necessarily use the residence age definition. Some children aged 20 to 24 included in eligible residence applications may have a specified visitor option, but this does not give every adult child a dependent student visa or permission to work. Check the actual category and conditions at each stage.

SMC also requires relevant family members already holding or applying for relationship-based work, student or visitor visas to be included as specified. Do not omit an existing family visa history to reduce paperwork. Declarations, eligibility and inclusion need to be assessed together.

English requirements begin at 16 for relevant family members, police certificate requirements concern applicants 17 or older, and health evidence has its own age rules. Prepare an accurate personal and financial outline first, then manage document dates. Individual eligibility must be assessed from the complete facts and current instructions, rather than a birthday alone.
