Can a BIV work visa be renewed? One further visa of up to two years
A BIV holder who needs more time for residence may consider one further work visa of up to two years under BD 8. It is not automatic. The business, applicant and relevant family must meet the applicable requirements, with a credible ability to achieve residence conditions within the additional period. Identify the actual shortfall before treating renewal as a solution.
Distinguish an eligibility gap from a pending resident application
The renewal provision concerns holders needing time to complete the operating period or the required additional ongoing employment of at least 12 months. Someone who has already lodged residence and is waiting for a decision has a different temporary-permission issue. These should not be treated as a single universal extension process.
BD 8 is not an exemption from the initial nine-month purchase-and-operation evidence requirement, nor an automatic restoration of an expired visa. Review the current permission, Establishment-stage outcome, genuine operating start and expected residence eligibility. An intention to seek a further visa is not a grant of it.
Renewal assessment | What the evidence must address |
Five full-time-equivalent jobs | The business's continuing actual employment |
Solvency and compliance | Financial, tax, legal and relevant immigration, employment and business standards |
Ownership | At least the proportion originally approved |
Applicant's involvement | Most time in New Zealand spent operating the business |
Applicant and family | Fit-and-proper and applicable residence health and character requirements |
A trading business still needs a complete assessment
Employment, financial, tax and professional evidence should describe the real operation, not just a list created on submission day. An originally higher ownership proportion cannot simply be reduced to 25% and assumed compliant. Solvency or regulatory issues need truthful disclosure; needing additional time is not a reason to omit them.
BD 8 describes the applicant as having spent the majority of their time, when in New Zealand, operating the business. It should not be reduced to presence days without considering the work performed. Residence's184-day and other tests also need their own assessment. Travel, duties and business evidence should explain a consistent factual position.
Show how the additional period can close the gap
Identify the operating or employment period missing, its actual start, what has already been completed and a supported completion date. The additional employment must meet its permanent, ongoing, full-time-equivalent and eligible citizen-or-resident requirements. An unfilled future recruitment plan cannot be recorded as months of employment already supplied.
The relevant standard or fast-track residence conditions still apply. Renewal does not convert an unacceptable business into an acceptable one. A faster objective needs the actual investment and eligibility basis, not merely a new label. The specialist must be satisfied that the requirements can credibly be met within the further period; a private optimistic timetable is not approval.
Check family requirements and the formal application
The principal applicant and included partner or dependent children must meet residence health and character requirements. Update genuine changes rather than copying old forms. Use the prescribed application process and pay the applicable fee and immigration levy. The initial application quotation should not be treated as a fixed renewal charge.
Address current permission before expiry, with work and travel governed by the actual conditions. Lodgement is different from a further visa grant. Retain official requests, responses and decisions separately. If a gap cannot be resolved in time, assess other lawful arrangements on the real facts rather than promising that the original work can always continue after expiry.
An approved renewal still leaves the operating, employment and evidence work, followed by the resident application and decision. One further visa of up to two years is not an indefinitely repeatable arrangement. Continue tracking outstanding conditions and official dates instead of treating a new work visa as completed residence eligibility for the family.
