New Zealand BIV or AIP? Compare active business operation with the investor pathways
BIV starts with buying and actively operating an acceptable established business under a work visa, followed by residence when its requirements are met. AIP uses qualifying Growth or Balanced investment with resident-visa conditions. These are not interchangeable payments for the same outcome. Start with the role the applicant intends and can genuinely fulfil, then compare capital and family arrangements.
Question | BIV | AIP |
Core activity | Actively operate an acceptable established business | Maintain acceptable category investments |
Principal investment minimum | NZD 1 million standard or NZD 2 million fast-track | NZD 5 million Growth or NZD 10 million Balanced |
Additional resources | At least NZD 500,000 reserves on top, plus real costs | Budget government, professional, investment and family costs |
Key period | Three years standard or 12 months fast-track before residence eligibility; fast-track operation still totals three years | 36 months Growth or 60 months Balanced investment period |
Presence direction | At least 184 days in each 12-month operating period and applicable conditions | 21 days during Growth or a 105-day Balanced baseline during its investment period |
Operating a business requires a different commitment
BIV is not wholly passive ownership with every responsibility delegated to a manager. Assess personal business experience, English, age and suitability, alongside the target's trading, staffing and compliance. Additional employment and the applicant's real operation also matter. Someone retaining a demanding overseas role should consider whether those responsibilities are workable before choosing the smaller headline amount.
AIP is not satisfied by purchasing any New Zealand asset either. Category-specific acceptable investments, maintenance, returned capital and evidence rules apply. Product suitability and risk need appropriate qualified assessment. Immigration feasibility should not be presented as a guarantee of capital preservation, returns or later liquidity.
Earlier residence eligibility is not the end of responsibility
BIV fast-track eligibility after at least 12 months of operation is not a promised one-year decision. Active operation must still total at least three years across the work and resident stages, with individual section 49 and ownership, presence, staff, solvency and compliance conditions. An earlier grant does not mean immediate sale or withdrawal is automatically acceptable.
AIP resident holders also need to satisfy investment-period conditions, evidence and questionnaires. Three years for Growth and five for Balanced are investment periods, not fixed government processing times. A later Permanent Resident Visa has its own requirements and application. Do not collapse a Resident Visa and permanent residence into one already completed result.
Use the right period for presence
BI 2.1 measures BIV presence from commencement of operation, with at least 184 days for each 12-month period. An arbitrary calendar year or a partner's days is not a substitute. AIP Growth requires at least 21 days as a resident holder during the 36-month investment period; Balanced has a 105-day baseline over 60 months. These are not identical annual-day requirements.
Balanced can permit a presence reduction for additional acceptable Growth-category investment, subject to the amount, nomination timing and continued investment conditions. It is not an unrestricted option to pay later and immediately reduce days. Assess the actual visa period and travel facts before calculating an individual's compliance.
Budget and evidence beyond the minimum
BIV excludes business property, GST, fees and transaction costs from the investment minimum, with additional reserves and real operating and family costs. AIP also involves government, professional, investment-related and household expenditure, with market and exchange-rate effects. Neither minimum is an all-inclusive family price or a forecast of better returns.
Source, ownership and lawful transfer must follow the relevant category. The ability to consider some gifts does not make every detail interchangeable. Family, health, character and evidence also need their own assessment. Prepare genuine assets, role, travel and risk constraints for appropriate professional review instead of choosing from a ranking of headline investment amounts.
