New Zealand BIV standard or fast-track: what changes between NZD 1 million and 2 million?

3 min read

Under BIV, an eligible investment of at least NZD 1 million supports the standard pathway, with at least three years of active business operation before residence eligibility. At least NZD 2 million supports the fast-track pathway, with at least 12 months before eligibility. The shorter period is not a guaranteed decision deadline or permission to leave the business after a year.

Decide whether active ownership suits the plan

Both routes require investment in and active operation of an acceptable established New Zealand business. Business experience, English, age, health, character and fit-and-proper requirements still apply. A higher payment does not replace the applicant's ability or intention to run the enterprise. Having a manager is not, on its own, evidence that the applicant can remain wholly passive.

The qualifying investment is not the entire acquisition budget. GST, the business property's value, fees and transaction costs are excluded. Reserve funds of at least NZD 500,000 are additional to the investment. Reconcile the interest being purchased, the applicant's expenditure and the qualifying amount, with operating cash needs and family costs budgeted separately.

The earliest date still depends on all residence evidence

Residence requires evidence of retained ownership, solvency, compliance, presence and employment. In addition to maintaining five full-time-equivalent staff, the business must create and maintain an additional ongoing full-time-equivalent job for a New Zealand citizen or resident for at least 12 months. If the new role starts later, the complete eligibility date may be later than the first anniversary of acquisition.

The work-visa stage also involves at least 184 days a year in New Zealand. Match the relevant periods to actual travel and operation. A business remaining open does not itself prove the owner was personally and actively managing it. Keep authentic decisions, financial records, employment and PAYE evidence as the enterprise operates, with each record supporting the condition it actually addresses.

Fast-track residence carries further business responsibilities

Active operation must still total at least three years across the work and resident visas. While completing that requirement, the holder must continue the relevant business, retain at least the approved ownership proportion, spend at least 184 days in each 12-month period in New Zealand, maintain five full-time-equivalent staff and keep the business solvent and compliant. Evidence is required within three months after the business has been operated for three years.

Read the actual resident visa and follow the section 49 removal procedure where applicable. An earlier resident grant does not mean immediate sale, withdrawal from management or automatic removal of conditions. Changes in the business or family should be addressed on their real facts rather than assuming the larger investment relaxes the obligations.

The first nine-month evidence milestone applies to both routes

The work visa's up-to-four-year duration includes an initial 12-month Establishment stage. Acceptable evidence of purchasing and beginning to run the business must be provided within the first nine months. Otherwise, the visa expires after the 12-month Establishment stage. An expression of interest, a deposit, completed acquisition and actual operation are separate events; fast-track investment does not remove this milestone.

Build a timeline connecting funds, acquisition, personal presence, management and employment. A Resident Visa, a later Permanent Resident Visa and citizenship are separate processes. Choose between routes using the full business and family commitment, not only the shorter number appearing in an advertisement.
