BIV residence pending and work visa expiring: the specific-purpose option of up to nine months
A pending BIV resident application does not automatically extend the work visa. The official resident-visa page describes a Specific Purpose Work Visa of up to nine months for eligible principal applicants to continue running their business while residence is processed. It is a separate permission to apply for and obtain, not time automatically added to the existing visa.
Check the two stated eligibility facts
The page requires the person to be the principal applicant for a Business Investor Resident Visa and hold a current Business Investor Work Visa. Someone merely planning to apply for residence later, or whose old work visa has expired, should not adopt the same conclusion without assessment. If the missing element is operating time or qualifying additional employment before residence eligibility, assess the separate BD 8 conditional renewal of up to two years. The nine-month pending-residence arrangement and an eligibility-gap renewal address different stages. Neither is a universal extension form that can be chosen by its convenient duration.

Lodgement and grant must remain separate
Record work-visa expiry, resident submission, receipts, official notices and outstanding evidence. Prepare using the current application process and applicable charges. Sending or acceptance of an application is not the grant of a new visa, and a private estimated decision date is not an effective permission date.
Current work, stay and travel depend on the person's actual valid conditions and official notices. Any applicable interim permission and its conditions require individual confirmation. Residence processing should not be used as a blanket assurance that all original work and re-entry rights continue unchanged. Check the real position before arranging travel.
Up to nine months is not indefinite permission
Use the actual granted duration and scope. The stated maximum does not promise a full nine months to everyone, nor a repeatable extension until residence is decided. If the new expiry approaches without a resident decision, assess the lawful next step in time. A longer processing period does not erase the permission's end date.
This arrangement concerns continuing the relevant business, not unrestricted access to any New Zealand job. A proposed sale, business change or withdrawal from management needs assessment for both current permission and residence. Waiting for a decision does not suspend every business requirement. Planned changes should not be recorded as approved facts.
Track family permission and residence evidence separately
The principal's possible eligibility does not automatically give the partner or children the same nine months or identical work and study conditions. List each person's category, expiry and relationship, and address the applicable process. Living or travelling together does not establish a common immigration status.
Outstanding family English, health or other resident evidence still needs attention by the official deadlines. Temporary work arrangements and resident requests are separate tasks; completing one does not close the other. Preserve originals and receipts and use suitable channels for sensitive personal material.
After a resident decision, read the actual new visa. Fast-track section 49 conditions can leave operating and presence obligations outstanding. Until the decision, keep residence marked pending. A specific-purpose work grant is not residence approval. Distinguishing government status from private service progress gives the family and business a reliable basis for the next action.
