Can gifted capital fund BIV? Donor source, unconditional ownership and transfer evidence

Current BIV rules allow qualifying gifted investment capital, including funds from parents, but not on the strength of a gift letter alone. The 6 July 2026 update and BD 2.15 require an unconditional gift made under local law, with lawful acquisition by the donor. A loan does not become a gift merely because the paperwork uses a different label.

Begin with how the donor obtained the resources

The specialist must be satisfied that the donor lawfully earned or acquired the funds, including where they derive from inheritance. A receipt in the applicant's account establishes one payment stage, not the donor's entire source. Salary, company distributions, asset sales and inheritance need evidence appropriate to the real history rather than a single generic family declaration.

An asset sale may involve earlier ownership, the actual transaction and receipt. A distribution needs the relationship between company and individual, while inheritance requires the entitlement and actual distribution. Suitable professionals determine the evidence for the circumstances. Do not manufacture events to fit a template; connect the donor's acquisition to the eventual transfer to the applicant.

The written gift and actual obligations must agree

The agreement, payment and real understanding between the parties should be consistent. A repayment obligation, temporary custody or another condition cannot be removed by deleting words from the document. Appropriate legal, accounting and banking professionals should address validity, tax and transfer procedures. This article does not determine an individual gift's legal effectiveness or tax outcome.

Nominated investment resources must also belong to the applicant or qualifying included family under the ownership rules. With another co-owner, only the applicant's evidenced portion can count. A parent holding sufficient money and promising future support is not the same factual position as the applicant already owning eligible resources.

Lawful source includes lawful movement

BD 2.15 requires acquisition and currency exchange to follow the relevant local laws. Domestic and international transfers must meet the banking or acceptable foreign-exchange and remittance requirements. Using an intermediary does not remove the upstream evidence. A screenshot of one intermediate receipt cannot independently explain every earlier source. Use genuine records and lawful procedures, not an invented transfer purpose.

Investment resources must also meet the unencumbered and borrowing rules. Particular post-grant financing conditions are not a blanket permission for any family loan before application. If money must actually be repaid, disclose and assess that arrangement instead of hiding the private obligation behind a gift description.

New Zealand-held funds still have a history

BD 2.15 contains limited exceptions to specified transfer provisions for funds or assets held in New Zealand for more than two years before application. They must still have originally arrived through the banking system or an acceptable foreign-exchange route from where they were lawfully acquired, or have been acquired lawfully in New Zealand. Two years is not a universal exemption from source evidence.

Nominated New Zealand assets are assessed at market value at application, not automatically the original purchase price. Valuation and lawful acquisition need their own support. Assess particular resources under the complete BIV instructions rather than importing gift restrictions wholesale from AIP or Parent Boost. Eligible capital remains only one part of the personal, target-business and active-operation requirements.
