BIV's first year: the nine-month evidence deadline and 12-month Establishment stage
BIV's up-to-four-year work visa includes an initial 12-month Establishment stage. The current operational instruction BD6.1 requires the evidence within nine months of the work visa being granted, during the Establishment stage. For an offshore grant, the visa validity generally begins on arrival, so the grant and arrival dates may differ. Record both and check the individual visa conditions against the two applicable time references. Without the required acceptable evidence, the visa expires after the 12-month Establishment stage. These are different milestones; month 12 is not the starting point for preparing the submission.
Establish the dates from the actual visa
The official page states that the visa is valid from arrival if granted offshore, or from grant if the applicant is already in New Zealand. Check the individual's eVisa, entry and conditions. Record approval, arrival, acquisition and commencement of operation separately rather than using the sale-agreement date for every purpose.
Work backwards to allow for professional reports, genuine payment, transfer of ownership and operating records. Family relocation and an existing business handover should fit the actual timetable. School or housing commitments do not automatically extend immigration deadlines. Establish who holds each required document and how it can be obtained lawfully before the deadline is close.
Keep the acquisition stages distinct
Stage | What it may establish | What it does not establish alone |
Negotiation or intention | A target is being considered | Purchase and operation completed |
Deposit | A specified contractual payment | Full completion |
Completed acquisition | The relevant transaction and rights | Every active-operation requirement |
Actual operation | Business activity and the applicant's role | Government acceptance of the stage evidence |
INZ provides the Operating Stage form, INZ 1398. Use its current version and the required evidence. Sending or uploading it is different from INZ accepting the evidence. Monitor official requests and decisions. A proposal describing future operation does not prove that the business later began trading under the applicant's management.
The financial, legal, corporate and personal records should relate to the same transaction and current version. If documents are missing, establish authentic sources rather than marking an incomplete transfer or planned management activity as finished. Keep receipts and final responses so the actual application stage remains clear.
A failed original sale has a limited replacement process
If the nominated purchase falls through for reasons outside the applicant's control, the official rules allow consideration of a replacement within the first six months of the work visa. Submit a complete Business Proposal and supporting evidence for the new target, whose price must be at least NZD 1 million. The nominated business can be changed only once. A voluntary change of preference should not simply be described as outside the buyer's control.
The first nine-month requirement to purchase and start operating still applies after a replacement. It does not restart with the new target. Check all requirements of the selected standard or fast-track pathway and the new structure. Preserve the real reason, dates and replacement evidence rather than inventing an explanation to fit the exception.
Acceptance of the initial evidence is not residence approval
If INZ approves the evidence, the visa continues for the remainder of the four-year period under its conditions. The holder must remain self-employed in the specified business type. Residence separately involves operation, presence, ownership, employment, solvency and compliance requirements. Completing a purchase does not automatically satisfy them.
Keep authentic employment, financial, decision and travel records during operation. Assess changes against any need for a variation of conditions. If more time is needed before residence eligibility, check the applicable further-visa options before expiry. An initial operating-stage confirmation is not indefinite permission to remain, and a later renewal or resident application is not guaranteed.
