After fast-track BIV residence: three-year operation, section 49 removal and permanent residence

Fast-track Business Investor residence does not end all business responsibilities. BI 4.1 requires at least three years of active operation across the work and resident stages, together with ownership, presence, employment, solvency and compliance conditions. Completing the activities, submitting evidence and obtaining formal section 49 removal are separate events.

Start with the actual resident conditions and completed period

At least 12 months of operation is the fast-track residence eligibility milestone, not a guaranteed decision date. The remaining operating period depends on the qualifying history already completed, rather than being exactly two years after grant for everyone. Reconcile the actual work and resident stages with the individual's conditions.

BI 4.1 concerns the business purchased during Establishment or approved through an applicable variation of conditions. Forming another company does not automatically allow unrelated operating periods to be combined. Keep the original grant, approved changes and authentic evidence, and assess major business or family changes promptly.

At least 184 days in each relevant 12-month period

Employment

Solvency and relevant immigration, employment and business compliance

The third anniversary is followed by an evidence deadline

Current instructions require relevant evidence within three months after the business has been operated for three years. Do not simply delete the task on the anniversary. Requesting a report, sending documents and government receipt should remain distinct statuses. Residence addresses, operations and professional evidence must cover the real periods, without retrospective invention of management or employment.

BI 2.15 identifies reliable independent operating, financial and tax evidence. It also requires a qualified statutory accountant's assessment of solvency and financial and tax compliance, and the appropriate lawyer's legal-compliance opinion. Reports need the actual business and period, with the required distinction from immigration-lawyer involvement. A personal assurance that everything is satisfactory is not a substitute.

A removal request still needs a written outcome

The current visa page lists a principal applicant's cover letter requesting removal with current contact details, valid passport copies for everyone included, evidence of compliance and proof of residential addresses during the three years. Check the submission method when applying rather than relying on an old article's postal address. Removing the conditions currently has no government charge, although professional and document costs are separate.

Under BI 4.5, conditions are cancelled after the specialist is satisfied they have been complied with and the applicable process with the holder is completed, followed by written advice. Related conditions on the included partner or dependent children are handled accordingly. A private checklist or an adviser having all the documents is not that official outcome.

Permanent residence and travel require separate attention

The official page says a Permanent Resident Visa may be sought after holding the Business Investor Resident Visa for at least two years and meeting all conditions. Section 49 conditions must first be met and removal requested, with the applicable PR requirements addressed. Time passing, compliance and approval are not interchangeable; the second anniversary does not automatically grant PR to the family.

Indefinite stay inside New Zealand differs from overseas travel rights. The resident page describes two years of travel rights, with the real dates on the individual's visa. Later travel needs the applicable variation or an eligible PR arrangement. Being offshore when travel conditions expire can affect the visa, so check before departure rather than relying on the resident label.

BI 4.1 also links included family conditions to the principal applicant's compliance. Maintain each person's passport, grant, removal and later approval records. Different family histories and dates need individual management. Keep any government-unconfirmed item open instead of describing completed business operation as completion of every family immigration process.
