BIV family arrangements: partner work, dependent children and the residence stage

A BIV work application can include an eligible partner and dependent children, not every relative automatically. BD 3.1 requires qualifying relationships and applicable residence health and character standards. Establish each person's age, relationship and actual needs before treating a family move as one undifferentiated immigration outcome.

Partner work permission still needs a grant

Current BD 3.1 allows a qualifying included partner to receive a work visa for the same period as the principal, with conditions permitting any occupation and location in New Zealand. Self-employment and employing others, directly or through an owned business, are permitted under these instructions. Listing the partner in an application does not mean that permission has already been granted.

A marriage certificate does not automatically replace applicable living-together and genuine, stable relationship evidence. Explain real locations, history and records without creating cohabitation to meet a relocation timetable. Read the actual granted eVisa rather than treating another family's open-work result as the partner's own conditions.

Children need the right dependency assessment and visa

Eligible dependent children may receive student or visitor visas appropriate to their needs, for the relevant principal-applicant period. Not every age automatically receives a student visa, and continuing parental payments do not alone establish every dependency requirement. Supply genuine birth, relationship and applicable dependency evidence for the actual child.

The resident page permits dependent children aged 24 or younger, but an age ceiling alone does not establish dependency. Relationship, marriage, children and financial dependence can change over the years between work and residence. Reassess the real circumstances instead of copying an earlier form. A family's wish to keep supporting an adult child is distinct from the immigration definition.

Family validity is linked to the principal's stages

BD 3.1 links the family's visas to Establishment and subsequent operation. If the principal does not satisfy the relevant stage requirements, family visas expire at the end of Establishment; when requirements are met they continue for the applicable remaining period. The programme's up-to-four-year description should not be rewritten as an unconditional fixed four-year permission for every family member from the outset.

Work entitlement and BIV employment counting are separate. BD 6.1 excludes business owners and relevant family of BIV operators from the five-FTE count at the operating-stage transition. A partner being allowed to work does not establish eligibility for every business employment metric. Assess the specific stage rather than simply using a family payroll list.

Residence inclusion and English need planning

The official resident page requires inclusion of a partner or dependent children who hold or have applied for New Zealand temporary entry visas based on their relationship with the principal. Different relocation dates do not justify silently omitting that history. Give the full position to the appropriate professional and assess the actual inclusion requirements.

At residence, the partner and dependent children aged 16 or older must address qualifying English background, tests or the permitted lesson option. Children younger than 16 have no such English requirement. The absence of a work-stage family test does not remove the later one, and family lessons cannot replace the principal's earlier work-visa English requirement.

Keep passports, expiry dates, work or study conditions, relationship evidence and later application statuses for each person. When the principal awaits residence or needs further work permission, review the family's own arrangements. One receipt does not extend everyone. Update records after official decisions, remembering that fast-track resident conditions can also affect included family; a service provider collecting documents is not the same as government completion.
