BIV's 184-day requirement: operating periods, travel records and active involvement

For BIV residence, BI 2.1 requires at least 184 days in New Zealand for each 12-month period since the applicant began operating the business. It is not a universal January-to-December test, and the starting point is not automatically visa grant or first arrival. Establish the actual commencement of operation, then place the principal applicant's genuine travel records within the relevant periods.

The 12-month presence periods in BI 2.1

Do not collapse different events into one convenient date

An offshore grant, later arrival, completion and commencement of operation can have different dates. Contracts, completion evidence, operating records and official documents should explain what happened. Where records disagree, obtain a genuine explanation instead of replacing every date with the sale-agreement date.

If operation began outside January, a calendar-year total alone does not address the correct periods. List actual arrivals and departures separately from planned trips. Boundary dates and incomplete periods need assessment under the applicable instructions; do not invent a universal proportional reduction or exception. A private calendar helps organise the facts but does not determine the government's assessment.

The business staying open is not the owner's presence

Employees or a manager keeping the enterprise running do not make the absent applicant physically present. A partner's days cannot simply be transferred to the principal applicant. Begin with personal travel records, then compare the result with management, overseas business and family commitments. Revenue entering a company account does not establish where its owner was.

Owners retaining overseas responsibilities should consider travel, family care and business commitments before acquisition. Update plans using the events that actually occur. A larger investment or an experienced team does not automatically reduce the 184-day requirement. Nor should extra days in one period be assumed to repair a shortfall in another.

Presence does not itself prove active business involvement

BD 9.1 concerns day-to-day operation, decision-making and strategic planning. Examples include team management, delivery or logistics, customers and sales, budgets and pricing, marketing, cash flow and compliance. Use evidence of duties genuinely performed, not invented activity designed to cover every example. Being in New Zealand without the required involvement is not a substitute for operation.

BI 2.15 identifies reliable independent-source evidence such as audited or financial records, bank revenue and expenses, tax records, equipment invoices and leases. Personal notes may assist an explanation, but a self-written management diary does not replace the required evidence. The business operating, the applicant participating and the applicant being present are related but distinct facts.

Fast-track residence may leave the presence obligation running

Where an earlier resident grant leaves part of the total three-year operating requirement outstanding, BI 4.1 continues the 184 days in each 12-month period alongside ownership, employment, solvency and compliance conditions. Moving from work to residence should not be treated as immediate permission to stop management or move away permanently. Read the actual individual conditions across both stages.

Completing three years also involves evidence submission and the applicable section 49 removal process. Enough days alone does not cancel every condition. Before travel, check the resident visa's real travel rights rather than equating indefinite residence inside New Zealand with unlimited re-entry from abroad.

Keep a dated record of commencement, each relevant period, travel, duties and supporting evidence. If circumstances change, update the plan and seek appropriate assessment promptly. Do not wait until submission to alter dates or treat a marketing promise as an alternative to the instructions.
