Capital Returned During Your AIP Investment Period: Reinvestment Deadlines and Records
If an AIP investment returns capital during the required investment period, do not assume the money is available for household spending. Establish whether the payment is capital, profit, a partial exit or something else, then review the reinvestment requirements. An acceptable investment can be changed, but the visa's continuing conditions and the applicable deadlines still matter.
INZ instruction BN9.5 provides a 90-day transfer period for direct investments or managed funds on Invest New Zealand's list, and 30 days for listed equities, philanthropy, property development or bonds. The period starts from the first working day after the funds come into the possession and control of the principal applicant or representative. Reading the email later does not create a new starting event.
Reconstruct the transaction before calculating
Obtain the original investment documents, the payment explanation, the actual receipt and details of anything still invested. A valuation report is not necessarily a payment, and a scheduled future distribution is not a completed return. Keep planned events separate from actual transactions so the review uses the right facts.
For a partial repayment, connect the amount to the original investment and remaining holding. Several products should have separate records rather than one combined account balance. Ask the manager to explain unclear payment components; a short bank reference does not establish which part is profit and which part is original capital.
Review the reinvestment amount by investment
BN9.5 addresses the original invested amount, the amount realised where a loss has occurred, or the amount required to meet the imposed conditions. Its note says that gains and losses across multiple investments need not be offset to determine the aggregate reinvestment amount; calculate by reference to each investment. Preserve the actual amounts and loss evidence instead of inventing a portfolio-wide adjustment.
The general management guidance explains that investment profits do not need to be reinvested under that provision. This is not permission to relabel returned capital as profit or withdraw principal early. Have the complete investment history and actual visa conditions reviewed, with financial explanations and immigration conclusions provided within the relevant professional scope.
Understand the limited Balanced-asset arrangement
Returned capital from direct investments or managed funds may be placed into an acceptable Balanced-category investment for the remainder of the period in specified circumstances. These include fewer than six months remaining, or an amount below NZD 1 million where the business immigration specialist is satisfied it cannot be reinvested into a direct investment or managed fund. An amount below the figure alone is not automatic approval.
For the small-amount confirmation described in BN9.5, the applicant has 30 days from confirmation to transfer and invest into the acceptable Balanced investment. INZ may need evidence of genuine attempts to find a suitable direct investment or fund. Keep enquiries and actual minimum requirements rather than asserting that nothing was available without research.
This specific investment arrangement is different from formally changing the application's Growth or Balanced category. Do not combine the rules or choose whichever deadline is longest. Contact INZ using its current instructions and retain the actual response before relying on a proposed exception.
Keep continuing-evidence dates visible
The management guidance requires Growth evidence at 24 and 36 months, and Balanced evidence at 24 and 60 months, supplied within three months of each relevant date. Establish the real investment-period starting point and connect every return and replacement. A current holding statement alone may not explain an earlier gap.
INZ also requires an investment questionnaire at 24 months and at the end of the investment period, with three months to complete each. Follow the approval letter for the actual process. Holding evidence does not replace the questionnaire; keep separate completion records for both tasks.
Obtain the appropriate manager confirmation or records for the asset involved, and retain the evidence index and actual submission receipt. Initial subscription, continuing holding, reinvestment and evidence acceptance are separate events. Immigration acceptability does not guarantee returns or capital recovery, and a deadline should not be used to pressure a family into an unreviewed product.
