Using a Parent's Gift or an Inheritance for AIP: Ownership Before Account Balance

Active Investor Plus funding does not necessarily have to be personally earned income, but a parental gift or inheritance still needs evidence of ownership, lawful acquisition and the applicable requirements. An account balance shows an amount at a particular time. It does not, by itself, establish how that amount lawfully became the principal applicant's asset.

Current INZ instruction BN6.5 requires gifted funds to be given unconditionally, in accordance with local law, and lawfully earned or acquired by the donor. A family agreement requiring repayment or allowing conditional recovery should be disclosed accurately. Changing the document's heading to gift does not change the arrangement's substance.

Build the record in three connected parts

Start with the donor's acquisition of the funds or assets, then document the actual gift and finally the applicant's receipt and ownership. These are different questions. A relationship certificate can explain who the parties are without establishing any of those financial events.

If a parent sold property, locate the acquisition, sale, mortgage repayment and net-proceeds records. For company distributions, separate the company's income, lawful distribution and the parent's receipt. This is a preparation framework, not a universal official checklist or assurance of acceptance. Missing historic records should lead to recovery enquiries and an honest account of the gaps, never newly manufactured statements.

Check the New Zealand history of a proposed gift

BN6.5 says nominated funds or assets that are or were in New Zealand cannot be gifted under those instructions. INZ's evidence guidance gives examples involving a relative's New Zealand account and distributions of funds previously invested there. Review the money's history rather than relying only on the donor's nationality or present residence.

Moving funds offshore and back does not establish that their earlier history has disappeared. The rules for the applicant's own lawfully held investments already in New Zealand are a separate issue. Do not turn the possible use of an existing personal asset into a claim that any relative's New Zealand gift is acceptable.

An inheritance has several stages

A will, probate, confirmation of entitlement, estate distribution and a bank receipt answer different questions. INZ lists evidence of the deceased person's acquisition of the funds as well as the inheritance process. Where there is no will, appropriate legal evidence of entitlement may be needed.

Keep entitled, administration pending, distributed and received as separate states. If several beneficiaries are involved, identify the applicant's actual share and any estate liabilities or restrictions. The total estate value is not an amount that every beneficiary can nominate independently. Unresolved rights and the time needed to realise assets require proper assessment before a transfer timetable is treated as workable.

Joint ownership depends on who is included

BN6.1 permits assessment of the full value of qualifying jointly owned funds or assets where the co-owner is a partner or dependent child included as a secondary applicant and the relevant requirements are satisfied. With a person not included in the application, only the portion supported by evidence of the principal applicant's ownership may be claimed. Family membership alone does not establish full-value treatment.

Make an asset index showing the holders, acquisition, share, liabilities and supporting documents. Do not assume every joint account needs a new gift between holders, or that every family account belongs entirely to the applicant. Obtain advice on the real legal ownership before changing arrangements.

Banking, transfer and local succession or gift requirements need their own consideration. Immigration acceptability does not approve every related transaction under another jurisdiction's law. Supply sensitive originals only to appropriate authorised recipients, preserve genuine versions and identify the evidence still needed. A concise, traceable file is more useful than an impressive declaration unsupported by the underlying history.
