NSW 190 Residence: What Changes When You Move Between NSW and Offshore?

3 min read

Moving between NSW and an offshore location can change which residence criterion applies to a subclass 190 nomination. NSW’s current guidance requires six months of continuous offshore residence for its offshore route. Its FAQ says that moving between NSW and offshore resets the relevant residence period. Keep a move separate from a temporary trip and review the full criteria before relying on a new address.

Check the route for your current circumstances

The subclass 190 page also provides onshore alternatives: paid work in the nominated occupation in NSW for at least 20 hours a week, or continuous residence in NSW for at least six months. It is therefore inaccurate to say that every onshore applicant must qualify through the six-month residence alternative. Each person must still satisfy the other applicable state and visa requirements.

Write down the criterion you intend to rely on and the evidence supporting it. Include the date the relevant situation began, your actual living arrangements and any unresolved issue. This is a preparation note, not an additional government form or a finding that the criterion has been met.

Build a residence history before changing the EOI

NSW says invitation rounds use the usual country of residence recorded in the EOI. An onshore or offshore selection must be supported by the applicant’s actual circumstances. Review the existing entry against your current situation rather than choosing the category that appears more favourable.

Create a dated timeline of actual moves, addresses and the documents available for each period. If you moved from NSW to an offshore location, do not simply add the time on each side together as one continuous residence period. Keep earlier records so the change can be explained, and check the procedure applicable to your actual invitation or application stage before making updates.

A holiday and a move are different factual questions

The NSW FAQ says short offshore holidays generally do not affect NSW residence where the person maintains their residence in the state, but individual situations are assessed case by case. It also says time in NSW on a tourist visa does not count towards the nomination residence requirement.

Record travel dates and retain evidence of the living arrangement you maintained. Where it is unclear whether an absence was temporary travel or a change of residence, describe the facts accurately and seek clarification. A ticket, a mailing address or an intention to return should not be treated as a complete assessment of the issue.

Make the evidence cover the period you are relying on

NSW’s FAQ requests at least six months of main transaction-account statements showing salary and everyday transactions, with applicable address evidence such as employment records, leases or bills. Documents must show the relevant name and address. If a listed item does not fit your circumstances, clarify the requirement rather than inventing an acceptable substitute.

An index can identify each file, its period and the residence fact it supports. Flag missing months and inconsistent addresses for review. Preserve complete original records and use the agreed submission process for any required personal documents.

For an initial discussion with 卓越移民 Premiervisa Group, explain your current location, the move dates and whether you rely on employment or residence. The next step is to establish the applicable criterion and evidence gaps. Relocating to meet a criterion does not guarantee an NSW invitation, nomination or visa.
