Hungary Family Reunification: What to Do After Divorce or a Sponsor’s Death
A family-reunification permit is based on a qualifying family relationship. If a marriage ends or the sponsor dies, do not rely only on the expiry date printed on the residence card to decide how long the family member may stay. Hungary’s immigration authority says the divorce or the death of a spouse must be reported to the regional directorate responsible for the person’s place of accommodation within 30 days of receiving the final divorce judgment or death certificate, with the document attached.
Report within 30 days after receiving the document
The family-reunification factsheet ties the deadline to receipt of the final divorce judgment or death certificate. The report goes to the regional directorate responsible for the person’s accommodation, and the relevant document must be attached. Keep the receipt date, copy of the report and proof of submission. If the document has not arrived or the family member is outside Hungary, confirm the required steps with the authority promptly.
A change in family status requires a new check
Do not assume the residence permit automatically ends on the divorce date, and do not assume it remains usable until the printed expiry date without further action. After reporting, check whether personal information must be updated, further evidence is required or another residence category may apply. If the family member already has a different valid residence basis, confirm its own conditions and expiry separately.
Some family members may have a right to continue residing
The authority says a family member who has not acquired residence on another legal basis is entitled to continue residing if five years have passed since the first issue of the residence permit, or, in the event of the sponsor’s death, if the conditions of residence are met. These are different situations. They should not be reduced to “five years of marriage guarantees residence” or “the sponsor’s death automatically renews the permit.”
To assess whether one of these provisions may apply, identify the issue date of the first family permit, the current permit category, the sponsor’s status and whether the other residence conditions are met. The public factsheet does not resolve every marriage, custody or family arrangement. Check the formal records with the competent authority or a qualified legal professional.
Documents to gather before contacting the authority
Prepare the final divorce judgment or death certificate, the date it was received, the family member’s residence card and passport, the first permit’s issue record, the sponsor’s status and any other residence documents. Make the required report within the 30-day period, then obtain written guidance on the family member’s next residence step. Do not plan long-term stay based only on an oral explanation or an unexpired card.
卓越移民 Premiervisa Group can help organise the report and residence records after a family-status change. Whether the person may continue residing or apply under another category depends on the individual case and the Hungarian authority’s current rules.
