Grenada Citizenship and the US E-2 Visa: Separate the Steps

Obtaining Grenada citizenship does not automatically give permission to live or work in the United States. A citizenship decision and an E-2 treaty investor decision involve different authorities and evidence. Assess both before treating them as one combined product.

Grenada citizenship and US E-2. Checklist: Citizenship assessment; US treaty eligibility; Separate enterprise evidence. Illustrative planning graphic.

Nationality is only one part of the US assessment

Under 8 USC 1101(a)(15)(E), a person who acquired the relevant nationality through financial investment and has not previously been granted E status is subject to a continuous domicile requirement of at least three years in that country before applying for an E visa. The wording concerns domicile, not simply holding a passport for three years. Its application to an individual history needs US immigration advice.

The State Department E visa guidance separately addresses the investor and enterprise. A treaty nationality does not establish that a proposed US business, the investment or the applicant’s role meets the requirements.

Questions to resolve

Citizenship

What route, eligibility, evidence and obligations apply?

Nationality history

How was the relevant nationality acquired, and is there previous E status?

Domicile

What facts and records are relevant to the statutory rule?

US enterprise

What business, investment and operating role are proposed?

Family plan

What separate immigration and practical arrangements need assessment?

Test the business plan independently

A business should make commercial sense apart from its immigration purpose. Examine the proposed activity, customers, operating costs, management and funding. A polished presentation does not prove that the applicant understands or can direct the enterprise.

Keep citizenship funds and the proposed US investment clearly documented. The two budgets may involve different payments and evidence. Do not assume that an investment made for citizenship also satisfies the US business investment requirement.

Is E-2 a US green card?

E-2 is a nonimmigrant category. It should not be marketed as an automatic US permanent residence outcome or as a substitute for assessing a long-term immigration plan.

Can an adviser promise that citizenship will lead to E-2 approval?

No. The responsible US professional should assess the nationality, domicile and business questions on their own facts. An approval in the first process does not bind the authority deciding the second.

Before committing funds, request a written explanation of the separate service scopes, responsible professionals and unresolved questions. A coordinated plan is useful only when its individual steps are realistic.

Define the two objectives separately

A family may be considering Grenada citizenship for one set of reasons and a US business visa for another. Write down both objectives. A second nationality, international mobility and operating a US enterprise are related planning interests, but they are not the same legal outcome.

The citizenship process assesses eligibility under Grenada's program. A US E-2 assessment examines a separate set of treaty and enterprise requirements. Completion of the first process does not establish completion of the second, and a provider should not describe them as one automatic transaction.

This distinction should appear in quotations, timelines and family discussions. Ask what each engagement covers, who is qualified to advise on each jurisdiction and what remains uncertain. A broad phrase such as Grenada to America is not a substitute for separate eligibility and business reviews.

Check nationality and treaty eligibility properly

Before relying on a citizenship plan for E-2 purposes, confirm the applicable US nationality and treaty requirements using current official material. Do not assume that any second passport creates the same route. Nationality is one part of the US assessment, not a general permission to live or work there.

The US statutory rule concerning certain nationalities acquired through financial investment is particularly important. It concerns qualifying continuous domicile before the relevant E-visa application, not merely keeping a passport in a drawer for three years. The precise rule and its application need individual US advice.

Do not describe time passing as a complete solution without examining residence and the statutory conditions. A family planning from Hong Kong or Taiwan may not intend to establish the relevant domicile at all. That factual intention should be discussed before citizenship expenditure is justified by an assumed US pathway.

Examine the proposed enterprise independently

The E-2 discussion should identify the actual enterprise, ownership, funding and role the applicant would perform. A business must be examined on its real facts. A brochure describing an E-2-ready opportunity does not establish that the transaction or applicant meets every requirement.

Separate the purchase price from the immigration analysis. A larger price is not automatically a qualifying investment, and a single advertised minimum cannot replace an assessment of the enterprise and applicable standards. Ask what the funds are committed to and what evidence supports the business account.

The commercial assessment also matters. Review financial records, liabilities, leases, staffing and the proposed operating model with appropriate independent professionals. A business can be risky even where an immigration route is worth examining. Visa preparation should not conceal investment risk.

Do not confuse temporary permission with permanent residence

An E-2 visa is not a US green card. Explain the actual nature of the proposed permission before using it as the foundation of a family relocation plan. A sales proposal should not imply that a business purchase automatically creates permanent residence or citizenship.

Ask about the principal applicant's intended activities and the separate position of accompanying family members. Work, study and future changes need advice based on current rules and the person's actual status. Do not assume that every family member receives identical rights from the same document.

Long-term planning should remain separate from the initial E-2 assessment. If permanent residence is an objective, obtain a distinct review of potential routes and uncertainty. A future possibility should not be represented as an included benefit of the citizenship or business transaction.

Build two budgets and a third business-risk schedule

The citizenship budget should identify its own official charges, investment or contribution, preparation and professional work. The US budget should identify the separate legal work, application-related costs and enterprise evidence. Avoid counting one broad package price as proof that every stage has been included.

The business-risk schedule should examine purchase funds, working capital, ongoing costs and the consequences if the visa or business plan does not proceed as hoped. These are commercial exposures, not government application fees. A refundable reservation and a committed investment can have very different consequences.

Request the payment milestones and refund terms for each provider and transaction. Do not assume that an unsuccessful US outcome reverses the earlier citizenship expenditure or unwinds a business contract. Read the actual agreements before relying on that assumption.

Coordinate advisers without merging responsibilities

Identify who handles Grenada citizenship, who gives US immigration advice and who reviews the business and tax position. Their work can be coordinated, but a recommendation in one area should not be presented as a professional conclusion in all the others.

Agree how relevant facts will be shared. Nationality history, domicile intentions, family circumstances and funds can affect more than one review. The objective is consistent factual information, not a single generic opinion that removes the need for jurisdiction-specific expertise.

Keep written records of the assumptions behind advice. If a business changes, a domicile plan changes or family circumstances develop, tell the relevant professionals. An earlier conclusion based on a different proposed enterprise should not be extended automatically to a replacement purchase.

Be precise about tax and banking claims

Citizenship, immigration residence, tax residence and bank acceptance are distinct questions. A new passport does not by itself establish that every tax obligation has ended or that every bank will open an account. Avoid treating these claims as automatic benefits in the migration decision.

Obtain advice based on actual residence, ownership and income arrangements. A household operating businesses in several jurisdictions may need more than one tax review. The purpose is to understand obligations, not to select a marketing slogan that makes the migration budget appear smaller.

Likewise, verify current travel rules for the actual destination and purpose. Visa-free travel, where available, does not necessarily authorise employment, settlement or business operation. Mobility and migration rights should be described separately.

A fictional staged assessment

Imagine a family interested in Grenada citizenship who also wants to buy a US business. The first review identifies whether citizenship is worthwhile on its own terms and whether the US plan depends on nationality, domicile and enterprise facts that remain unresolved.

The family then obtains separate US and commercial advice before treating a proposed purchase as suitable. If the domicile plan is not practical or the business is unattractive, that finding should be allowed to change the strategy. Earlier enthusiasm is not a reason to continue with a weak plan.

The useful outcome is a staged decision with clear dependencies. It may support further investigation, recommend a different route or advise against proceeding. No responsible article or adviser can promise that acquiring citizenship will automatically produce an E-2 visa, a profitable enterprise or US permanent residence.

Questions before combining the two plans

Is three years of passport ownership the same as domicile?

No. The relevant US statutory language concerns continuous domicile in the applicable circumstances, not merely the time since a passport was issued. That distinction can be decisive for someone intending to continue living elsewhere. Obtain US advice on the actual nationality history, prior status and proposed application. Do not use a calendar countdown as a substitute for the legal and factual review. A citizenship sales proposal should make this issue visible before the household relies on an assumed E-2 pathway to justify the expenditure.

Can a citizenship agent guarantee the US stage?

No provider can guarantee the government's visa decision. Identify who is giving US immigration advice and the precise scope being offered. An introduction to a US lawyer, business-search support and preparation of an E-2 application are separate services. The citizenship engagement should not imply that all of them are automatically included. Ask for written eligibility reasoning and unresolved conditions. A package can coordinate work, but it should preserve clear responsibilities and uncertainty rather than present two jurisdictions as one guaranteed product.

Is there one business purchase price that always qualifies?

Do not rely on a universal advertised amount. The E-2 assessment examines the actual enterprise, investment and applicant circumstances under the applicable standards. A business seller's E-2-ready label is not a government determination. Obtain independent immigration and commercial review before treating a price as sufficient. Consider ownership, committed funds, operating needs and the applicant's role. A transaction can meet a seller's commercial expectations while still leaving immigration questions unresolved, so the purchase agreement and visa strategy deserve separate examination.

Should I buy a business before the US review?

Understand the relevant immigration requirements and contractual exposure before committing. Some aspects of an investment may need to be examined as part of the E-2 strategy, but that does not justify signing an unsuitable agreement without advice. Identify the funds at risk, conditions, escrow arrangements where applicable and consequences if the plan changes. The appropriate sequence depends on the actual transaction. A provider should explain those dependencies instead of using urgency to make a household commit before understanding what the money purchases.

Does E-2 mean the whole family can work freely?

Family status and permitted activities need separate current advice. Do not assume every accompanying person receives identical rights or that a visa label answers all employment questions. Identify the principal applicant, spouse and children and their intended activities. The answer should reflect the actual status and current rules. If permanent residence or a child's longer-term future is important, obtain a distinct review rather than treating the initial E-2 plan as a guaranteed solution to every later family immigration question.

How should tax planning fit into the sequence?

Obtain advice based on actual residence, ownership, income and intended activities in the relevant jurisdictions. A passport and a visa are not complete tax analyses. The household may need separate advice in more than one country. Share consistent facts with the professionals involved and distinguish assumptions from settled arrangements. Do not describe a new nationality as automatically ending obligations elsewhere. Tax planning can affect commercial choices and costs, so it should not be left as an unsupported benefit added to the migration proposal after purchase.

What if Grenada citizenship is worthwhile but E-2 is unsuitable?

Assess the citizenship objective independently and decide whether it still meets the household's needs at the actual cost. The family does not have to preserve the original combined plan simply because the two were first presented together. A candid US review may change the business objective or timing. Keep the earlier expenditure and future commitment separate in the decision. The useful question is whether the next step remains sensible, rather than whether continuing would make the original sales narrative appear consistent.

What is a sensible final decision record?

Keep the citizenship assessment, US nationality and domicile review, enterprise assessment, family plan, budgets and unresolved conditions distinct. Identify the professional responsible for each conclusion and the facts on which it depends. Before a major payment, confirm which dependencies have actually been resolved. This produces an understandable staged plan. It may support proceeding, further investigation or stopping. It should never convert citizenship approval into a promised US visa, green card, tax outcome or profitable business result that has not been independently established.

Discuss the plan with our Hong Kong team

For an initial English-language enquiry, explain your objective, current location and the relevant work or family background. Our Hong Kong contact can coordinate the questions and written service scope. Australian and citizenship-program eligibility remains based on the actual applicant, not the location of the enquiry.
