EB-1A High Remuneration Evidence: Pay Records and Meaningful Comparators
There is no single EB-1A salary amount that applies to every profession. The remuneration criterion compares your pay for services with that of others in your field. Establish what you actually earned or commanded, explain the nature of each component, and use comparison data whose scope is clear. Company turnover, a founder’s net worth and personal compensation are different measures.
Separate proof of pay from proof of relative level
Section 204.5(h)(3)(ix) concerns a high salary or other significantly high remuneration for services in relation to others in the field. A senior job title alone does not answer the pay or comparison questions. The regulation does not provide a universal dollar threshold or a percentile that guarantees acceptance.
Prepare a compensation schedule separating base salary, bonuses and other service-related remuneration, with the relevant periods and original supporting records. This is a preparation method, not a rule requiring every petitioner to submit an identical set of documents. The appropriate evidence and legal treatment depend on the actual case.
Reconcile contracts, payments and tax records
A contract records agreed terms; payroll and banking records support payment; tax documents reflect a particular reporting period and basis. Reconcile these functions rather than presenting a possible future payment as money already received. If employment began partway through a year, distinguish an annualised rate from actual income for that year.
Gross compensation will differ from net bank receipts after deductions. Explain the calculation without altering the source records. Tax years, calendar years and company bonus periods can also differ. State the start and end dates. Where conversion is needed, retain the currency, exchange-rate source and date. Translating a number into US dollars does not make an otherwise unsuitable comparator relevant.
Explain whom the comparison represents
For a salary survey or other reliable industry source, retain its occupation classification, geographic scope, year, sample and compensation definition. An average for all employees is not automatically a meaningful comparison for a specialist in a particular field. Explain material differences in duties or experience rather than selecting an unusually low figure to amplify the gap.
A survey may include base pay but exclude bonuses and equity. If your own figure includes all components, explain the mismatch or seek a better-aligned source. This does not mean every case must use a single prescribed dataset. It means the reader needs to know what the numbers measure. Do not combine incompatible online figures into an invented ranking.
Record bonuses and equity at their actual stage
Identify the services and period associated with a bonus and keep the formal award and payment records. For equity, distinguish grant, vesting, exercise, sale and valuation. A maximum potential contract value is not the same as realised compensation. Preserve conditions and restrictions so the relevant legal and financial professionals can assess the evidence and calculation.
Do not add all unvested shares, business valuations or investment returns to salary. Differences between compensation letters, banking records and tax documents may reflect timing, currency, restrictions or tax treatment. Investigate and explain them rather than discarding inconvenient records. Questions about taxation should receive the appropriate advice, rather than a conclusion invented for the immigration file.
Keep business revenue separate from personal services
An owner may receive salary, distributions, equity and other income, each with a different basis. Company sales cover costs and other people’s work; they are not automatically the founder’s remuneration. Similarly, a consulting contract can include subcontractors, team costs and expenses. Explain what relates to your own services and what supports the amount attributed to you.
Index the necessary contracts, confirmations, payment records and financial information before sharing sensitive material. Foreign-language documents need the applicable full English translation and translator certification of accuracy, completeness and competence. Even persuasive remuneration evidence does not independently establish an entire EB-1A case: sustained acclaim and expertise at the very top of the field remain part of the overall requirements.
