EB-1A Original Contributions: Connecting Your Work to Major Significance

To prepare EB-1A original-contribution evidence, start with one verifiable piece of work. Explain what you contributed, what was original, who used it and what supports its significance in the field. A patent or publication may establish part of that account. It does not automatically establish that the contribution was of major significance.

Separate originality from major significance

Section 204.5(h)(3)(v) addresses original scientific, scholarly, artistic, athletic or business-related contributions of major significance in the field. “What is the original contribution?” and “Why is it significant in the field?” are related but different questions. Novelty, expense and importance to your employer do not independently answer the second one.

Retain dates, versions, authorship or inventorship, your responsibilities and traceable sources. Avoid beginning with a claim of a world first and then trying to make the records fit. If the underlying work supports a narrower description, use that description. Expanding the vocabulary does not expand the documented impact.

Build the link from work to use and effect

An evidence schedule can connect the contribution, user, application, result and supporting source. Where a technology was adopted, identify the version used, the purpose and the record supporting the reported effect. This is an organising method, not a rule that every occupation must produce sales contracts or a fixed number of customers.

For patents, distinguish application, publication, grant and other statuses. Being a named inventor does not make every commercial benefit your sole achievement. Separate the patent record from licensing, use or other evidence of impact. Lack of commercial adoption should not become an invented automatic refusal rule either; the relevant evidence depends on the nature of the contribution.

For citations, retain the database, search date, author identification and relevant citing material. A total does not explain how the work was used, and there is no universal citation number guaranteeing this criterion. A passing literature reference and substantive use of a method are different facts. Describe the actual relationship without converting every citation into a major application.

Use explanations that can be checked

A supporting expert can explain how they know the work, your role and its effects, referring to relevant records. Collaborators and non-collaborators should each write within their real knowledge. Do not ask someone unfamiliar with the work to claim direct observation, or present several similarly worded endorsements as separate proof of documented impact.

Internal business records can help show what happened, but explain the period, source, calculation, other factors and your contribution. A company’s revenue increase does not automatically establish that one invention caused all of it or that the wider field experienced a major effect. Distinguish observed facts, analysis and unverified inference.

Several documents may support one contribution. Renaming it does not create several different contributions. For collaborative work, preserve the actual division of responsibility and obtain appropriate confirmation where available. Discuss lawful disclosure of confidential material before sending research, customer records or trade secrets. An evidence index can identify the issue without distributing protected files.

Check dates and the complete evidentiary chain

For every central statement, follow the index back to its source and check what the source actually establishes. A later confirmation of an earlier event is different from an achievement that occurred later. Record both dates accurately. Section 103.2(b)(1) concerns eligibility at filing and through adjudication; questions about later evidence require assessment of the specific facts.

Foreign-language documents need the applicable full English translation and translator certification of accuracy, completeness and competence. Keep terminology and name variations traceable. Original contributions are only one EB-1A criterion: sustained acclaim and expertise at the very top of the field remain part of the overall requirements. Where significance is not supported, address that substantive gap rather than replacing it with stronger adjectives.
