EB-1A Award Evidence: Recipient, Selection Rules and Recognition
An EB-1A award file needs more than a certificate with “international” or “excellence” in its title. Establish what you actually received, what achievement it recognised, and what supports national or international recognition of the award. Participation, a shortlist and a winning result are different facts. Start with the original result, not the description you would like the certificate to convey.
Match the award to the criterion
Section 204.5(h)(3)(i) concerns your receipt of nationally or internationally recognised prizes or awards for excellence in your field. It is distinct from the separate provision for a major internationally recognised one-time achievement. An award is not automatically excluded because it is not a world-famous honour, but an overseas organiser does not, by itself, establish the required recognition.
Make a short record of the award, year, category, named recipient and official result. The records discussed here are preparation suggestions, not a mandatory attachment list for every petition or a list of awards guaranteed to qualify. The assessment needs the actual award and its context.
Use the rules for your award year
Obtain the eligibility rules, assessment criteria, selection process, judges’ background and published result applying when you won. If the current website describes a different system, request dated historical material from the organiser. A competition that became global later should not be described as global in an earlier year without evidence.
If participation figures, geographic reach or selection rates are available, retain their source and definitions. Do not invent missing figures. Invitations open to the world do not demonstrate actual worldwide participation. The number shortlisted is not necessarily the total number who entered. Explain what a statistic measures before using it to describe the award’s selectivity.
Separate recognition from the organiser’s promotion
An organiser’s account can explain how its scheme operates. Consider what reliable material supports recognition of the award within the field, including relevant professional records or independent coverage. These are possible evidence sources rather than a rule requiring coverage by a particular newspaper. Describe what each source establishes and avoid treating repeated promotional copy as several independent endorsements.
An entry fee is different from purchasing a false award. Record genuine fees, sponsorship and promotional arrangements accurately. Neither declare every paid competition invalid nor assume payment purchases qualifying recognition. Do not request retrospective statements about competition or judging that did not occur.
Check who received a team or company award
A company named as recipient should not be rewritten as its founder. Retain the official list and explain your actual connection to the recognised work. Team achievements must not be presented as work you completed alone. Whether the evidence supports this criterion requires assessment of the full facts and applicable interpretation; your role description cannot change the original recipient.
Where names differ between a certificate and results page, investigate spelling, former names or a possible different recipient. Obtain corrections from an authorised issuer when needed. Do not alter scans or translations yourself. A certificate, announcement and photograph of one award are supporting records of that award, not three separate prizes.
Create a traceable evidence file
Index the result, selection rules, recognition material and your relationship to the award, including dates and page references. Foreign-language documents require the applicable full English translation and translator certification of accuracy, completeness and competence. Keep restrictions and qualifications in the translation. A certificate-only file may leave central questions unanswered.
If records are missing, identify the gap before relying on the award. EB-1A also requires sustained acclaim and expertise at the very top of the field. Producing documents under three headings is not automatic approval. A qualified US legal professional can assess how the verified award evidence fits the petition as a whole.
