Subclass 191 Hong Kong stream: Can you include an adult dependent child?

An adult child can be included in a subclass 191 Hong Kong stream application if they meet the relevant family criteria. Start by checking whether they still qualify as a member of the family unit and whether they hold an eligible visa. Home Affairs sets out additional dependency requirements for adult children without an eligible visa. If your child is approaching 23, consider whether they could reach that age before a decision.

Check the child’s own visa grant

Home Affairs says family members generally do not need an eligible visa while they still meet the family unit definition. If your child no longer meets that definition, check whether they hold an eligible visa granted to them as a member of the main applicant’s family unit. Keep the child’s grant notice and current visa details available so you can check the basis on which it was granted.

Prepare evidence of financial dependency

An adult child under 23 who is relying on dependency needs evidence of support from the main applicant or their partner. The documents can include a birth certificate or adoption records, Form 47a, and bank statements, transfers or rent receipts. Organise the evidence by date and identify who paid for the child’s main living expenses.

If a parent pays the child’s rent, for example, match the lease and receipts to the transfers. Explain inconsistencies in names, addresses or dates with supporting records. An enrolment letter can explain the child’s circumstances. Keep separate evidence showing who actually provides financial support.

Check what happens if the child turns 23 before a decision

Home Affairs says that if a child without an eligible visa is likely to turn 23 during processing, you will need evidence that they depend on you or your partner because of physical or cognitive limitations. This includes a report from a qualified medical practitioner. Check the child’s circumstances and applicable requirements before lodging if their birthday is approaching.

If you need help checking the visa pathway, prepare the child’s date of birth, current visa, basis of grant and a summary of who pays their regular expenses before contacting Premiervisa Group.
