Subclass 189 Hong Kong stream: How to document visa compliance after changing jobs or moving onto a bridging visa
Clause 189.241 of Australia's Migration Regulations requires substantial compliance with the conditions of the eligible subclass 457, 482 or 485 visa held at application and any subsequent bridging visa held by the applicant. Build a timeline that identifies the visa in effect, its actual conditions and what happened during that period.
Start with the grant notices and employment dates
Keep your grant correspondence, condition details and available VEVO records. A current VEVO record helps establish your present status. Use dated notices and other records when you need to establish which conditions applied in the past.
If your visa imposed employment restrictions, record your last day at work, the end of employment and the date you started any new role. An employer nomination, a visa grant and a start date are separate events. Depending on the circumstances, employment contracts, payslips, termination notices and correspondence may help establish what happened. If your last pay date was later than your last working day, label the dates separately and preserve the supporting records.
Record when a bridging visa actually takes effect
If you receive a bridging visa after lodging the 189 application, check when it comes into effect and whether the previous visa is still in effect. Read the work and travel conditions on the relevant notice before taking action. Keep records of changes in status during processing. Clause 189.241 also covers the conditions of a subsequent bridging visa, so compliance evidence can extend beyond the day you lodge.
Identify any period that needs an individual assessment
Set out the date, the condition that applied, your actual activities and the supporting records. Where information is missing, identify which document or issuer can help clarify the facts. The legal test refers to substantial compliance. Whether a particular event affects an application depends on the conditions and facts involved. Keep the original records and seek an individual assessment if the timeline raises a concern.
