Subclass 494 to 191: Why Three ATO Assessments Still Matter Without an Income Threshold

A subclass 494 holder preparing for the subclass 191 Regional Provisional stream should separate the income test from the document test. Home Affairs says there is no minimum income requirement, but applicants must still provide Australian Taxation Office (ATO) notices of assessment for three income years within the five-year period of an eligible visa.

Check the visa period and stream first

Subclass 191 has separate streams, so confirm which criteria apply before collecting evidence. For the Regional Provisional stream, the applicant must have held an eligible subclass 491 or 494 visa for at least three years and meet the other applicable requirements. Keep the visa grant record and a clear timeline of the eligible visa period.

The tax evidence is for three relevant income years within the eligible five-year period. It is not simply any three tax documents. An original notice and an amended notice for the same year remain documents for one income year; the date you downloaded or reprinted a notice does not change the year it relates to.

A tax return receipt is not a notice of assessment

A Notice of Assessment (NOA) is issued by the ATO after it assesses a tax return. A lodged tax return, an accountant’s submission receipt, payslips, bank deposits or an estimated refund do not automatically replace the NOA. Check the issuing authority, applicant’s name, income year and whether the document is an original or amended assessment.

If a notice is missing, check the ATO correspondence area linked through myGov, then ask the ATO or tax agent whether the return has not been lodged, is still being processed, or was assessed but the copy cannot be found. Each situation needs a different follow-up. Questions about whether a return must be lodged or how overseas income is treated should go to a qualified tax professional who knows the person’s circumstances.

Low or no income does not remove the document requirement

The current Home Affairs page expressly says there is no minimum income requirement for this stream. It also separately requires the three ATO assessment notices. Do not report income that was not earned to obtain a document, or assume that a foreign tax statement, overseas tax receipt or explanation that no return was required is an Australian NOA. If no notice exists for a year, establish the actual reason, keep the correspondence and ask an immigration professional what evidence is relevant to that case.

Keep amended notices, tax debts and TFNs separate

Regulation 191.222 refers to notices of assessment and notices of amended assessments for the relevant years. If a return is corrected, retain both versions and note the issue date and reason. Do not submit only the version that appears more favourable. Home Affairs also asks applicants to provide evidence that an ATO debt has been repaid or that an approved payment plan is in place. A request for instalments is not the same as an approved plan.

The regulation allows a copy of a relevant notice to omit the Tax File Number (TFN). If redaction is needed, hide only the TFN field and preserve the original document securely. Keep the applicant’s name, income year, assessment details and issue information visible. Tax documents contain sensitive personal information: share them through an agreed secure channel, never in a public group, and never share a myGov password.

Use an income-year checklist

For each year, record whether the NOA is available, whether an amended assessment exists, any ATO debt or approved repayment evidence, and what remains to be checked. A family can maintain one index, but each notice must remain linked to the correct applicant; different people’s years cannot be combined to make up the primary applicant’s evidence. Keep the original ATO document in English. A translation or family summary helps communication but does not replace the official notice.

Having three years of tax documents does not by itself establish every subclass 191 criterion or guarantee a grant. First confirm that each year falls within the relevant period, then check the eligible visa, compliance and other requirements for the person’s circumstances.
