Australia 189 Partner Points: Five, Ten and the Evidence Behind Each Category
For Australia’s points-tested 189 visa, distinguish the skilled-partner ten-point category, the competent-English five-point category and the ten-point category for being single or having an Australian citizen or permanent resident partner. They are not cumulative rewards for the same partner. Leaving a spouse out of the travelling party does not make you single.
The skilled-partner category has a complete set of conditions
Home Affairs lists ten points where the spouse or de facto partner is also an applicant for the same visa subclass and is not an Australian citizen or permanent resident. The additional requirements at invitation include being under 45, having competent English, nominating an occupation on the same applicable skilled occupation list and holding a suitable assessment from the relevant authority, other than an assessment for a subclass 485 visa.
Being on the same list does not mean you must have the same job. Conversely, an occupation appearing somewhere in the migration system is not enough without checking the list applicable to the claim. Read the occupation, authority, purpose and dates on the assessment rather than relying only on a positive result.
Five points for English is a different category
The five-point row also requires a partner applying for the same subclass who is not an Australian citizen or permanent resident and has competent English. Do not import the under-45 and skills-assessment conditions from the skilled-partner row into this different row. Assess the actual category instead of assuming that a missing assessment means every partner-points option is unavailable.
Partner points are also separate from the main applicant’s English points and any family English-charge arrangements. A willingness to pay an additional charge does not establish competent English for a points claim. Keep the evidence and purpose of each English record clear; this article does not set out test-score tables or determine an individual exemption.
Being single is a relationship fact
The separate ten-point category covers being single or having an Australian citizen or permanent resident partner. It is not an option created by choosing not to include an existing spouse or de facto partner. An absence of a marriage certificate does not, by itself, establish that no de facto relationship exists. Describe the real relationship accurately.
Home Affairs expressly notes that changes in marital status during processing can affect this category and that it is not assessed only at invitation. Do not assume the invitation permanently fixes these points. Changes after invitation require a proper assessment of the application, timing and applicable requirements, rather than a simple arithmetic adjustment.
Prepare one evidence schedule for the category relied on
Record the relationship, each person’s status, whether the partner is an applicant for the same subclass and the conditions applying to the selected category. Add age, English, occupation-list and assessment records where relevant. Some fields will be inapplicable to a particular category; mark why instead of forcing every row into one universal checklist.
Separate a pending test or assessment from a completed result. Keep names, dates and original records consistent across both people’s applications. Relationship evidence explains the relationship; an English result explains language ability; an assessment explains its specific occupational findings. No single document automatically replaces the others.
Keep a record when the facts change
Retain the version of the points calculation, supporting records and date of each review. An EOI summary, invitation and visa application are different records. If a claim appears overstated, establish the correct facts and obtain individual advice promptly instead of altering a relationship date or assessment history to fit an earlier calculation.
Where both partners are considering being the main applicant, compare the complete profiles separately using the same verified facts. An extra five points is only one part of that decision; occupation eligibility, genuine evidence and the application requirements still matter. None of the partner categories guarantees an invitation or visa grant.
