Who Can Join an Australia Subclass 186 Visa Application? Family Rules and Evidence
An Employer Nomination Scheme subclass 186 application can include eligible family members. The definition is specific, and a relative is not automatically a dependant. Check each person’s relationship, dependency status, timing and evidence before lodging so the family application is planned correctly.
Which family members may be included
Home Affairs lists a partner, a dependent child or stepchild of the applicant or partner, and a dependent child of one of those dependent children. A person who holds a subclass 457 or 482 visa may also be included in a defined situation where that visa was granted as a member of the applicant’s family and the applicable requirements are met. A family relationship alone may not establish dependency, particularly for an adult child.
When can family members be added
Eligible family members can generally be included when the subclass 186 application is lodged. They may also be added after lodgement but before the Department decides the visa application. If someone will be added later, notify the Department promptly, confirm the required process and charges at that time, and allow time to provide documents. A person omitted from the application should not assume they will be granted a visa automatically.
Prepare evidence that matches the relationship
Partners may need marriage or relationship evidence. For children, prepare birth, adoption or guardianship records that establish the relationship. Include name-change documents where relevant. An adult child or another family member whose dependency must be shown may need evidence addressing the actual dependency criteria. Documents that are not in English should be translated in line with the Department’s current instructions; retain the original and the translation.
Applicants aged 18 or over have a separate English requirement
Home Affairs requires family members aged 18 or older to demonstrate Functional English or pay a second instalment of the visa application charge where the rule applies. This is separate from the primary applicant’s English requirement. Check each family member’s age, accepted evidence and the current charge rules; the primary applicant’s English result does not satisfy another person’s requirement.
Use a family checklist before lodging
List each proposed family member, their date of birth, relationship to the primary applicant, whether they will apply together, current visa status, English evidence and any missing records. If a marriage, birth, care arrangement or other family detail changes before decision, update the Department through the official process. Subclass 186 is a permanent visa, but each included family member must still satisfy the applicable criteria, including health and character requirements.
This is general information about family members in subclass 186 applications. Eligibility and dependency evidence depend on the person’s circumstances and the current Home Affairs rules. Premiervisa Group’s subclass 186 service page is available for enquiries.
