Switching a 482 role from payroll to ABN invoicing: what if the work stays the same?

If you have been paid through payroll and your employer now asks you to obtain an ABN and invoice each month, while your duties, hours and supervision appear unchanged, do not assume that a contract labelled “contractor” settles your status. The Fair Work Ombudsman says that holding an ABN or issuing invoices does not automatically make someone an independent contractor. A subclass 482 visa holder also needs to check their visa conditions separately.

This article covers a change to the payment arrangement for an existing main role. It does not mean every contractor arrangement is unlawful, or that a new label resolves workplace, tax and visa questions. Employees and genuine independent contractors can have different rights and responsibilities. The applicable legal test and the actual relationship matter.

Establish what is changing

Ask the employer to set out the effective date, duties, hours, payment method, expenses, and any change to leave, superannuation, insurance or other arrangements. Keep the original employment agreement, payslips, rosters and proposed contract. Do not sign blank or backdated documents. If the change is described as administrative, ask why it also changes costs, rights or responsibility.

Facts to organise

Records to keep

Who directs the work

Hours, location, work methods and instructions

Tools and business risk

Who supplies equipment, pays costs and bears the risk of mistakes

How the work is performed

Whether another person may do the work and whether payment is by time or result

How the change happened

Old and new terms, effective date, who proposed it and when it began

These questions help organise the facts; they are not a scorecard. Fair Work tests can differ depending on the business, the period of work and the circumstances. The contract and how the arrangement operates in practice may both matter. One factor alone is not enough for a conclusion. Seek appropriate workplace legal advice if the classification is disputed.

Compare the full cost, not just the invoice rate

Set out the old pay, proposed rate, leave, superannuation, insurance, equipment, tax and administration costs separately, and ask who will carry each item. An invoice marked “including tax”, the end of payroll withholding or a higher bank deposit does not by itself establish worker status or show that all tax obligations have been met. Confirm the rights that apply to your actual arrangement.

If someone asks you to backdate a document, describe the employment arrangement as if it never existed, or threatens dismissal, keep the original messages and dates. If ABN payments have already started, record the work performed, payments and actual change date accurately. Do not alter records to make the change appear earlier or later.

Check the 482 visa separately

A subclass 482 holder must follow the conditions attached to their visa, including the nominated occupation and the applicable sponsor and business arrangements. Registering an ABN, lodging tax returns or receiving a workplace-law opinion does not change a visa condition. The rules can depend on when the visa was granted and the individual circumstances. Check the grant notice and VEVO, then have a qualified migration professional review the nomination, both contracts, the actual work arrangements and the date of change.

Do not assume that changing back to payroll later will resolve an earlier period, or rely on a general statement that the change “will not affect a future 186 application.” If the work has already changed, keep a factual record of the dates and arrangements. If you also receive a government or dismissal notice, check its deadline separately; do not assume that waiting for advice pauses it.

Official information

Checked 21 October 2026. The applicable Fair Work test depends on the business, work period and full relationship. For a 482 visa, check the individual grant and VEVO record.
